Casual terms award review 2021

The Fair Work Commission was required to review relevant terms in modern awards on the basis of their interaction with the new casual employee definition and casual conversion arrangements (AM2021/54), under clause 48 of Schedule 1 of the Fair Work Act 2009.

The Commission had to complete its review by 27 September 2021.

Where the review found an inconsistency, difficulty or uncertainty, the Commission varied the modern award as soon as possible.

The Casual terms award review 2021 was be conducted in 2 stages:

• Stage 1: a 5 member Full Bench considered the nature and scope of the review, and reviewed relevant terms in a small group of modern awards that raised a range of possible interaction issues. The Full Bench issued a decision on the outcome of its review of the initial group of awards, and also determined the process for the second stage of the review.
• Stage 2: a Full Bench of 3 members of the initial Full Bench reviewed the remaining modern awards in convenient groupings.
