When a regulated labour hire arrangement order is in force, the protected rate of pay doesn’t apply to engagements of 3 months or less (exemption period). Use Form F86 to apply to us for a different exemption period or no exemption period.

Who can use this form
Only use Form F86C if you are:
- the regulated host
- an employer covered by the regulated labour hire arrangement order
- a regulated employee covered by the regulated labour hire arrangement order, or
- an employee organisation or employer organisation that is entitled to represent the industrial interests of any of the above.

Before you start
Have this information ready before you start the Form F86C. You will need to tell us:
- your contact details
- your representative’s contact details (if you have one)
- details about the regulated labour hire arrangement order (or application for an order, including case number)
- information about the regulated host, employer, regulated employees, and employee organisations
- details of the exemption period you are applying for, and
- the exceptional circumstances that apply.

What happens next
You must send (serve) a copy of the application on:
- the regulated host (if the regulated host is not the applicant)
- each employer covered by the order, and
- each employee organisation that can represent a regulated employee or an employee of the regulated host (that you know of).
We will email you to confirm we have received your application.
Applications are dealt with by a Member who may then organise a hearing or conference.
