The Commission is considering a number of applications to vary the General Retail Industry Award 2020.
The Commission has determined to join these proceedings together, such that they will be heard concurrently.
You can find a short summary of each matter below.
AM2024/9 | In February 2024 the Australian Retailers Association made an application under section 158 of the Fair Work Act 2009. It seeks to vary multiple clauses in the Award intended to improve award flexibility and to clarify entitlements. Some variations sought in this application have already been made. Other aspects of the application have been designated to be dealt with in later proceedings. |
AM2024/26 | In June 2024 Mr Anthony Hicks made an application under section 160 of the Fair Work Act 2009 to vary Schedule A.8.3(a) of the Award to insert the words “or duty manager”. |
AM2024/33 | In August 2024 the Commission commenced proceedings on its own initiative to consider proposals to vary the Award made in the ‘making awards easier to use’ stream of the Modern Award Review 2023-24. |
AM2024/40 | In September 2024 the Shop, Distributive and Allied Employees’ Association made an application to vary the Award under section 158 of the Fair Work Act 2009. It seeks to vary Schedule A.6.2 and A.7.3 of the Award to clarify the classification structure. |
Previously, the Fair Work Commission commenced proceedings under section 160 of the Fair Work Act 2009 (AM2023/17) to vary the Award. AM2023/17 is now closed (see [2024] FWCFB 197).
