Some cases relating to the road transport industry must be determined by an Expert Panel.
The Expert Panel for the road transport industry can determine cases relating to:
- modern awards that relate to the road transport industry
- road transport minimum standards orders
- road transport guidelines
- road transport contractual chain guidelines.
The President of the Commission might consider an employee-like worker minimum standards application relates to the road transport industry. In that case, the President may direct an Expert Panel to deal with the case.
Expert Panel members have knowledge or experience relating to the road transport industry.
Road transport objective
The Expert Panel for the road transport industry must consider the road transport objective when it performs its functions.
This means the Expert Panel, in conducting its functions, must consider the need for an appropriate safety net of minimum standards for regulated road transport workers and employees in the road transport industry, including the need:
- for standards that ensure the road transport industry is safe, sustainable and viable
- to avoid unreasonable adverse impacts on
- sustainable competition among road transport industry participants
- viability, innovation and productivity of road transport industry businesses
- administrative and compliance costs for road transport industry participants
- to avoid adverse impacts on the sustainability, performance, and competitiveness of supply chains and the national economy
- for minimum standards in road transport contractual chains.
