4 yearly review of modern awards – common issue – public holidays.
[1] Following the Mention held on 7 April 2016, draft directions were published on the Commission’s website and parties were provided with an opportunity to comment on the draft directions.
[2] Ai Group was the only organisation to comment on the draft directions and it suggested a change to the date of the mention. We have incorporated Ai Group’s suggestion into the directions we propose to make (copy attached).

4 yearly review of modern awards – common issue – public holidays.
The Fair Work Commission directs as follows:
1. Any party seeking variations to the public holiday provision in any modern award shall file in the Commission the draft variation determination(s) sought; comprehensive written submissions and any witness statements or documentary material on which the party seeks to rely, by 5.00pm Monday 10 October 2016.
2. Any interested party which wishes to adduce evidence and/or make submissions in reply to any of the evidence and submissions filed in accordance with direction [4] shall file such evidence and/or submissions in the Commission by 5.00pm on Wednesday 15 March 2017.
3. The matter will be listed for mention at 1.00pm (AEST) on Wednesday 22 March 2017. It is anticipated a hearing will be scheduled during April, 2017.
4. All submissions and evidence shall be sent to [email protected].
Note: the part-day public holiday aspect of this common issue will be determined after the other public holiday common issues have been determined in 2017.
