Section 160 of the Fair Work Act 2009 (Cth) – variation on the Commission’s own motion – residual variations – Wine Industry Award 2020.
A. Further to the decision issued by the Full Bench on 8 July 2022 [[2022] FWCFB 119], the above award is varied as follows:
1. By inserting the superscript “1” after the words “Grade 5” appearing in the table in clause B.1.1.
2. By deleting the amount “52.62” appearing in the table in clause B.1.1 and inserting
“–“.
3. By inserting the following note after the table appearing in clause B.1.1:
1 Grade 5 rates do not apply to cellar door employees.
4. By inserting the superscript “1” after the words “Grade 5” appearing in the table in clause B.2.1.
5. By deleting the amount “59.20” appearing in table in clause B.2.1 and inserting “–“.
6. By inserting the following note after the table appearing in clause B.2.1:
1 Grade 5 rates do not apply to cellar door employees.
B. This determination comes into operation on 11 July 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 11 July 2022.
