Section 160 of the Fair Work Act 2009 (Cth) – variation on the Commission’s own motion – residual variations – Cement, Lime and Quarrying Industry Award 2020.
A. Further to the decision issued by the Full Bench on 8 July 2022 [[2022] FWCFB 119], the above award is varied as follows:
1. By deleting clause 18.2(d) and inserting the following:
(d) First aid allowance
An employee:
(i) who has been trained to provide first aid;
(ii) who holds a current and appropriate first aid qualification (such as a certificate from St John Ambulance or similar body); and
(iii) who is appointed by the employer to act as a first aider
is entitled to the following first aid allowances which will be paid for all purposes:

B. This determination comes into operation on 11 July 2022. In accordance with s.165(3) of the Fair Work Act 2009 this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 11 July 2022.
