4 yearly review of modern awards – Joinery and Building Trades Award 2010 – modern award varied – correction.

A. The determination issued by the Full Bench on 7 December 2020 [PR724784] is corrected as follows:

1. By deleting clause 25.4(a) appearing in the attachment to the determination and inserting the following:

(a) Other than for work on a Saturday, Sunday or public holiday, the rate of pay for afternoon and night shift is 150% of the ordinary hourly rate, provided that the employee is employed continuously for 5 shifts Monday to Friday in any week.

2. By deleting clause 25.4(b) appearing in the attachment to the determination and inserting the following:

(b) Other than for work on a Saturday, Sunday or public holiday, the rate of pay for early morning and early afternoon shift is 125% of the ordinary hourly rate, provided that the employee is employed continuously for 5 shifts Monday to Friday in any week.

3. By moving the column titled “Afternoon or night” across the table under the heading “Continuous shiftwork” next to the “Early morning or early afternoon” column appearing in clauses B.2.3, B.2.6 and B.3.6 of the attachment to the determination.

4. By deleting the word “shift” in the heading “Afternoon or night” appearing in clause B.3.3 of the attachment to the determination.

5. By moving the column titled “Afternoon or night” across the table under the heading “Continuous shiftwork” next to the “Early morning or early afternoon” column appearing in clause B.3.3 of the attachment to the determination.

6. By deleting the number “24” appearing in the title of Schedule 24 of the attachment to the determination and inserting the letter “X”.

7. By renumbering clauses J.5 to J.6.2 appearing in Schedule X of the attachment to the determination as clauses X.1 to X.2.2 respectively.

B. This determination comes into operation on 1 March 2021. In accordance with s.165(3) of the Fair Work Act 2009, this determination does not take effect in relation to a particular employee until the start of the employee’s first full pay period that starts on or after 1 March 2021.
