4 yearly review of modern awards – Educational Services (Schools) General Staff Award 2010
[1] Further to the Full Bench decision issued in transcript by the Fair Work Commission on 21 December 2015, the above award is varied as outlined below.
[2] By deleting paragraph “(c)” of clause 15.2 and inserting the following:

[3] By deleting subclause “(b)” of clause 16.5 Sleepover allowance and inserting the following:
Clause 16.5(a) does not apply to an employee who is provided with reasonable accommodation including living quarters, fuel and light, and available to the employee for their exclusive use at no cost to the employee.
[4] By deleting paragraph “(ii)” of clause 22.5(c) and inserting the following:
an employee who is provided with accommodation on the employer’s premises or in the vicinity of the employer’s premises at no cost to the employee.
[5] By deleting “clause 24 Breaks” and inserting the following:
24.1 Meal break
An employer is required to provide an unpaid meal break of not less than 30 consecutive minutes to an employee who is engaged or rostered to work for more than five hours on a day. Such meal break will start no later than five hours after the employee commenced work on that day.
24.2 Rest break
An employee is entitled to a rest break of 10 minutes for each period of three hours worked, with a maximum of two rest breaks per shift.
Where the employee has an entitlement to two rest breaks, in place of the two 10 minute rest breaks:
the employer and the employee may agree to one rest break of 20 minutes; or
the employer may require one rest break of 20 minutes, where the employee is engaged in classroom support services.
A rest break:
will be counted as time worked;
will be taken at a time suitable to the employer; and
will not be taken adjacent to a meal break, unless the employee and the employer agree.
[6] By adding the following sentence at the end of paragraph (iv) under Schedule B.2.2(d):
An instructional services employee (sport) will have no or minimal coaching experience but will possess appropriate sporting discipline specific experience.
[7] By inserting the following new paragraph (viii) into Schedule B.2.2(e):
Instructional services grade 1
Providing assistance to sporting teams/squads under the supervision of a teacher or an instructional services employee (Grade 3 or above)
Assisting with equipment and the preparations for, and conducting of, training sessions and/or sporting events
Occupational equivalent: Sports assistant
[8] By adding the following sentence to the end of paragraph (iii) of Schedule B.2.3(d):
For an instructional services employee (sport), this means coaching qualifications equivalent to those identified in paragraphs (i) to (ii) and/or appropriate sporting discipline specific experience.
[9] By inserting the following new paragraph (vii) into Schedule B.2.3(e):
Instructional services grade 2
Providing assistance to individuals and/or sporting teams/squads under the supervision of a teacher or an instructional services employee (Grade 3 or above)
Assisting with equipment and the preparations for, and conducting of, training sessions and/or sporting events
Occupational equivalent: Sports assistant, assistant sports coach
[10] By adding the following sentence to the end of the paragraph (v) of Schedule B.2.4(d):
For an instructional services employee (sport), this means coaching qualifications equivalent to those identified in paragraphs (i) to (iv) and/or appropriate sporting discipline specific experience.
[11] By deleting “(vii) Instructional services grade 1” in Schedule B.2.4(e) and inserting the following:
Instructional services grade 3
Instructing individual students as part of an extra-curricular instrumental music program
Coaching, including developing sports training sessions and programs, for individuals and/or teams/squads in various sporting disciplines
Supervising instructional services employees (Grades 1 and/or 2)
Occupational equivalent: instrumental music tutor, senior assistant sports coach, sports coach
Note: An instrumental music tutor will not be employed at a Level lower than Level 4.
[12] By adding the following sentence at the end of paragraph (vi) under Schedule B.2.5(d):
For an instructional services employee (sport), this means coaching qualifications equivalent to those identified in paragraphs (i) to (v) and/or appropriate sporting discipline specific experience.
[13] By deleting “(vi) Instructional services grade 2” under Schedule B.2.5(e) and inserting the following:
Instructional services grade 4
Preparing instrumental music students for external examination in their discipline as part of an extra-curricular program
Coaching individuals and/or sporting teams/squads, including developing and implementing individual- and/or team-specific training sessions and programs
Supervising instructional services employees (Grades 1, 2 and/or 3)
Occupational equivalent: music tutor, sports coach, senior sports coach (large school)
[14] By adding the following sentence at the end of paragraph (iii) under Schedule B.2.6(d):
For an instructional services employee (sport), this means coaching qualifications equivalent to those identified in paragraphs (i) to (ii) and/or appropriate sporting discipline specific experience.
[15] By deleting “(vi) Instructional services grade 3” under Schedule B.2.6(e) and inserting the following:
Instructional services grade 5
Conducting and co-ordinating a school choir, band or musical ensemble or more than one of these
Managing and delivering the full coaching/training program or a significant distinct part of a coaching/training program for one or more sporting disciplines
Supervising employees, including instructional services employees (Grades 1, 2, 3 and/or 4) or coaching (individuals, squads and/or teams) and managing sporting facilities
Occupational equivalent: choir master, conductor, head coach
[16] This order comes into operation on and from 21 December 2015. In accordance with s.165(3) of the Fair Work Act 2009 this order does not take effect until the start of the first full pay period that starts on or after 21 December 2015.
