2. COMMENCEMENT AND DURATION OF AGREEMENT
2.1 This Agreement shall commence seven days after it is approved by the Fair Work Commission

[1] Wood Australia Pty Ltd T/A Wood Australia (the Employer) has made an application for the approval of the Wood Offshore Maintenance Services Greenfields Agreement 2021 (the Agreement). The application was made under s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single enterprise greenfields agreement. [2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met. [3] I note that Clause 12.1 – Ordinary Hours of Work is potentially inconsistent with the National Employment Standards (NES). Noting the NES precedence clause at 6.2 in the Agreement, I am satisfied that the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES. [4] The Australian Workers’ Union (AWU) was a bargaining representative for the Agreement and has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the AWU. TITLE l. l This Agreement shall be known as the "WOOD Offshore Maintenance Services Greenfields Agreement 2021 ". 2. COMMENCEMENT AND DURATION OF AGREEMENT 2.1 This Agreement shall commence seven days after it is approved by the Fair Work Commission and shall remain in force for four years from the approval date. After the nominal expiry date, this Agreement will continue to operate until terminated or replaced. 3. APPLICATION OF AGREEMENT AND PARTIES COVERED 3.1 This Agreement shall cover and apply to: a) WOOD Australia pty Ltd ("the Company''); and b) Employees of the Company employed in a classification specified in Cl. 34 - Classifications,engaged to perform 'Maintenance Work' on an Offshore Facility operated by the Client in state or Commonwealth waters off the coast of Western Australia or the Northern Territory; and c) The Australian Workers' Union. 4. DEFINmONS "Act" means the Fair Work Act 2009 (Cth) "Brownfields Modification and Upgrade Work" means work involving maintenance, modification and upgrade of an existing (that has been previously or is currently operating) Client facility, installation and/or system. "Casual" is an Employee engaged as such in accordance with the Act. "Client" means Woodside Energy Ltd or any member of the Woodside Group of Companies. "Company" or "Employer" means the Company being WOOD Australia pty Ltd. "Continuous Shiftworker" means an Employee engaged in an enterprise in which shifts are continuously rostered 24 hours per day, seven days per week and who is rostered regularly to work those shifts and works 'regularly' on Sundays and public holidays. A Continuous Shift Worker will be a shift worker for the purposes of the NES. For the avoidance of doubt 'regularly' means an On-duty period consisting of more than 34 Sundays and 6 public holidays in a given year. "Demobilisation Shift" means the day the employee travels from the Offshore Facility to commence their Off-Duty Period. "Employee" means an employee of the Company to whom this Agreement applies. "Emergency or Pandemic Situation" means an emergency/situation declared under applicable emergency legislation or a directional order issued by an industry regulator (i.e. NOPSEMA) requiring an immediate coordinated response. "Full Time" is an Employee engaged as such on an ongoing basis (i.e. permanent). "Greenfields Construction Work" means hook-up, commissioning and completions work of a new Client facility, installation and /or system that has not previously produced oil or gas, which is not Brownfields Modification and Upgrade Work. "Immediate Family" means a spouse, defacto partner, child, parent, grandparent, grandchild, or sibling of the Employee; or a child, parent, grandparent, grandchild or sibling of a spouse or de facto partner of the Employee. "Maintenance Work" means all preparatory work to and the undertaking of maintenance and Wood Offshore Maintenance Greenfields Agreement 3 1. DEFINITIONS "Act" means the Fair Work Act 2009 (Cth) "Brownfields Modification and Upgrade Work" means work involving maintenance, modification and upgrade of an existing (that has been previously or is currently operating) Client facility, installation and/or system. "Casual" is an Employee engaged as such in accordance with the Act. "Client" means Woodside Energy Ltd or any member of the Woodside Group of Companies. "Company" or "Employer" means the Company being WOOD Australia Pty Ltd. "Continuous Shiftworker" means an Employee engaged in an enterprise in which shifts are continuously rostered 24 hours per day, seven days per week and who is rostered regularly to work those shifts and works 'regularly' on Sundays and public holidays. A Continuous Shift Worker will be a shift worker for the purposes of the NES. For the avoidance of doubt regularly' means an On-duty period consisting of more than 34 Sundays and 6 public holidays in a given year. "Demobilisation Shift" means the day the employee travels from the Offshore Facility to commence their Off-Duty Period. "Employee" means an employee of the Company to whom this Agreement applies. "Emergency or Pandemic Situation" means an emergency/situation declared under applicable emergency legislation or a directional order issued by an industry regulator (i.e. NOPSEMA) requiring an immediate coordinated response. "Full Time" is an Employee engaged as such on an ongoing basis (i.e. permanent). "Greenfields Construction Work" means hook-up, commissioning and completions work of a new Client facility, installation and /or system that has not previously produced oil or gas, which is not Brownfields Modification and Upgrade Work. "Immediate Family" means a spouse, defacto partner, child, parent, grandparent, grandchild, or sibling of the Employee; or a child, parent, grandparent, grandchild or sibling of a spouse or de facto partner of the Employee. "Maintenance Work" means all preparatory work to and the undertaking of maintenance and Wood Offshore Maintenance Greenfields Agreement 3serv1cmg, Brownfields Modification and Upgrade Work (including comm1ss1onmg and de commissioning) and shut down work and associated miscellaneous work on or in connection with the production, processing, piping and distribution of hydrocarbons or other ancillary products however described, to or from oil and gas fields, and work Incidental thereto on an existing installation, facility and/or system. The work shall not include Greenfields Construction Work. "Mobilisation Shift" means the day the employee travels to the Offshore Facility to commence their On-Duty Period. "NES" means the National Employment Standards as per the Act. "Night Shift" means any shift scheduled to finish after midnight and at or before noon; except in the circumstances detailed in subclause 13.6. "Offshore Facility" or "Offshore Facilities" means all offshore sites, installations, facilities and/or systems operated by the Client, but does not include Offshore Facilities in waters off the coast of any other state of Australia other than Western Australia or the Northern Territory. "Offshore Pay" means the amount paid when an Employee is considered to be working offshore which includes the applicable hourly rate of pay, applicable allowances and includes the Offshore Allowance. "Off-duty Period" means a period in a Work Cycle during which an Employee does not have shifts. Days during an Off-duty Period are unpaid non-working days. The Off-duty Period shall commence on the day of demobilisation from the Offshore Facility. "Onshore Pay" means the amount paid when an Employee is considered to be working onshore which includes the base hourly rate of pay, applicable allowances and excludes the Offshore Allowance. "On-duty Period" means a period in a Work Cycle during which an Employee has rostered shifts, being either day or night shifts. The On-duty Period shall commence on the arrival at the Offshore Facility. "Over Cycle" means hours worked on the Offshore Facility in addition to the Rostered Hours of Work. "Point of Assembly" or "POA" means the Company appointed airport where the Employee boards the helicopter to travel to or from onshore to the Offshore Facility. For the avoidance of doubt, this is currently specified by the Client as Karratha Heliport. "Point of Hire" or "POH'' means either the POA airport, or the nearest capital city airport to the Employee's Usual Place of Residence when the Employee is employed by the Company. For avoidance of doubt, the Point of Hire will be stipulated in the Employee's Letter of Offer and will remain as this location unless changed by agreement by both the Company and the Employee. "Rostered Hours of Work" means the hours an Employee is scheduled to work on a particular shift during the Employee's On-duty Period which are made up of ordinary hours. "Swing" means the Employee's designated roster panel of On-duty Period of the Employee's Work Cycle. "Union" means The Australian Workers' Union. "Usual Place of Residence" means the location in Australia at which the Employee resides when they are not on the Offshore Facility which is notified to the Company by the Employee prior to employment and updated in accordance with this Agreement. "Work Cyde" means a period consisting of On-duty Period/sand an Off-duty Period/s where, except for Work Cycles introduced in an Emergency or Pandemic Situation, Over Cycle and not induding mobilisation or demobilisation days which may be worked; the number of On-duty days Wood Offshore Maintenance Greenfields Agreement 4 servicing, Brownfields Modification and Upgrade Work (including commissioning and de- commissioning) and shut down work and associated miscellaneous work on or in connection with the production, processing, piping and distribution of hydrocarbons or other ancillary products however described, to or from oil and gas fields, and work incidental thereto on an existing installation, facility and/or system. The work shall not include Greenfields Construction Work. "Mobilisation Shift" means the day the employee travels to the Offshore Facility to commence their On-Duty Period. NO EXTRA CLAIMS 5.1 It is a fundamental term of this Agreement that parties covered by this Agreement will not forso long as the Agreement remains within its nominal term: a) support or advance any other or extra daims; or b) threaten, organise or engage in any industrial action in support or connection with suchextra claims or any other matter unless as provided for under the Act. 6. OPERATION OF AGREEMENT 6.1 The terms of this Agreement shall operate to the exclusion of any industrial award, agreement or instrument that would otherwise regulate the wage rates and/or terms orconditions of Employees covered by this Agreement. 6.2 No provision of the NES is displaced by this Agreement, other than to the extent permitted under the NES. Accordingly, the NES will continue to apply to the extent that any term of this Agreement is detrimental in any respect when compared to the NES. 7. FLEXIBIIL TY Enterprise Flexibilitv 7.1 All Employees will carry out lawful directions and duties that are within the skill, competencyand training of their respective classification provided the Employee is capable of performingthe work in a safe manner. Individual Flexibilit y 7.2 The Employer and Employee covered by this enterprise agreement may agree to make an individual flexibility arrangement to vary the effect of terms of the agreement if: a) the agreement deals with one or more of the following matters: i. arrangements about when work is performed; ii. allowances; and iii. leave loading. b) the arrangement meets the genuine needs of the Employer and Employee in relation to 1 ormore of the matters mentioned in paragraph a); and c) the arrangement is genuinely agreed to by the Employer and Employee. 7.3 The Employer must ensure that the terms of the individual flexibility arrangement: a) are about permitted matters under Section 172 of the Act; and b) are not unlawful terms under Section 194 of the Act; and c) result in the Employee being better off overall than the Employee would be if noarrangement was made. 7.4 The Employer must ensure that the individual flexibility arrangement: a) is in writing; and b) includes the name of the Employer and Employee; and c) is signed by the Employer and Employee and if the Employee is under 18 years of age,signed by a parent or guardian of the Employee; and d) includes details of: i. the terms of the enterprise agreement that will be varied by the arrangement; and ii. how the arrangement will vary the effect of the terms; and Wood Offshore Maintenance Greenfields Agreement 5 does not exceed the number of Off-duty days. 5. CONSULTATION Consultation Clause Application 8.1 The parties will consult as provided for in this clause when the Company: a) has made a definite decision to introduce a major change to production, program, organisation, structure or technology in relation to its enterprise that is likely to have asignificant effect on the Employees; or b) proposes to introduce a change to the regular roster pattern or ordinary hours of work of Employees. Maior change 8.2 For a major change referred to in 8.1 (a): a) the Employer must notify the relevant Employees and the unions covered by the Agreementof the decision to introduce the major change; and b) subclauses 8.3 to 8.9 apply. 8.3 The relevant Employees may appoint a representative for the purposes of the procedures inthis term. 8.4 If: a) a relevant Employee appoints, or relevant Employees appoint, a representative for thepurposes of consultation; and b) the Employee or Employees advise the Employer of the identity of the representative, the Employer must recognise the representative. 8.5 As soon as practicable after making its decision, the Employer must: a) discuss with the relevant Employees: i. the introduction of the change; and ii. the effect the change is likely to have on the Employees; and iii. measures the Employer is taking to avert or mitigate the adverse effect of the change on the Employees; and b) for the purposes of the discussion--provide, in writing, to the relevant Employees: i. all relevant information about the change including the nature of the change proposed; and ii. information about the expected effects of the change on the Employees; and iii. any other matters likely to affect the Employees. 8.6 However, the Employer is not required to disclose confidential or commercially sensitive information to the relevant Employees. 8. 7 The Company must give prompt and genuine consideration to matters raised about the major change by the relevant Employees. Wood Offshore Maintenance Greenfields Agreement 6 ili. how the Employee will be better off overall in relation to the terms and conditions of his or her employment as a result of the arrangement; and e) states the day on which the arrangement commences. 7.5 The Employer must give the Employee a copy of the individual flexibility arrangement within14 days after it is agreed to. 7.6 The Employer or Employee may terminate the individual flexibility arrangement: a) by giving no more than 28 days' written notice to the other party to the arrangement; or b) if the Employer and Employee agree in writing -- at any time. 8. Wood Offshore Maintenance Greenfields Agreement 68.8 If a term in this agreement provides for a major change to production, program, organisation, structure or technology in relation to the enterprise of the Employer, the requirements set out in paragraph 8.2(a) and subclauses 8.3 and 8.5 are taken not to apply. 8.9 In this term, a major change is likely to have a significant effect on Employees if it results in: a) the termination of the employment of Employees; or b) major change to the composition, operation or size of the Employer's workforce or to theskills required of Employees; or c) the elimination or diminution of job opportunities (including opportunities for promotion or tenure); or d) the alteration of hours of work; or e) the need to retrain Employees; or f) the need to relocate Employees to another workplace; or g) the restructuring of jobs. h) change to regular roster or ordinary hours of work. 8.10 For a change referred to in paragraph 8.1.b): a) the Employer must notify the relevant Employees of the proposed change; and b) subclauses 8.11 to 8.15 apply. 8.11 The relevant Employees may appoint a representative for the purposes of the procedures inthis term. If: a) a relevant Employee appoints, or relevant Employees appoint, a representative for thepurposes of consultation; and b) the Employee or Employees advise the Employer of the identity of the representative, the Employer must recognise the representative. 8.12 As soon as practicable after proposing to introduce the change, the Employer must: a) discuss with the relevant Employees the introduction of the change; and b) for the purposes of the discussion--provide to the relevant Employees: i. all relevant information about the change, including the nature of the change; and ii. information about what the Employer reasonably believes will be the effects of the change on the Employees; and iii. information about any other matters that the Employer reasonably believes are likely to affect the Employees; and c) invite the relevant Employees to give their views about the impact of the change (includingany impact in relation to their family or caring responsibilities). 8.13 However, the Employer is not required to disclose confidential or commercially sensitive information to the relevant Employees. 8.14 The Employer must give prompt and genuine consideration to matters raised about thechange by the relevant Employees. 8.15 In this term "relevant Employees" means the Employees who may be affected by a changereferred to in subclause 8.1. Consultative Committee 8.16 The Company as part of its oommitment to cnntinuous impl'O\eTlent will within 3 months of empoyees rovered Wood Offshore Maintenance Greenfields Agreement 7 8.8 If a term in this agreement provides for a major change to production, program, organisation, structure or technology in relation to the enterprise of the Employer, the requirements set out in paragraph 8.2(a) and subclauses 8.3 and 8.5 are taken not to apply. 8.9 In this term, a major change is likely to have a significant effect on Employees if it results in: a) the termination of the employment of Employees; or b) major change to the composition, operation or size of the Employer's workforce or to theskills required of Employees; or c) the elimination or diminution of job opportunities (including opportunities for promotion or tenure); or d) the alteration of hours of work; or e) the need to retrain Employees; or f) the need to relocate Employees to another workplace; or g) the restructuring of jobs. h) change to regular roster or ordinary hours of work. 8.10 For a change referred to in paragraph 8.1.b): a) the Employer must notify the relevant Employees of the proposed change; and b) subclauses 8.11 to 8.15 apply. 8.11 The relevant Employees may appoint a representative for the purposes of the procedures inthis term. If: a) a relevant Employee appoints, or relevant Employees appoint, a representative for thepurposes of consultation; and b) the Employee or Employees advise the Employer of the identity of the representative, the Employer must recognise the representative. 8.12 As soon as practicable after proposing to introduce the change, the Employer must: a) discuss with the relevant Employees the introduction of the change; and b) for the purposes of the discussion -- provide to the relevant Employees: i. all relevant information about the change, including the nature of the change; and ii. information about what the Employer reasonably believes will be the effects of the change on the Employees; and ili. information about any other matters that the Employer reasonably believes are likely to affect the Employees; and c) invite the relevant Employees to give their views about the impact of the change (includingany impact in relation to their family or caring responsibilities). 8.13 However, the Employer is not required to disclose confidential or commercially sensitive information to the relevant Employees. 8.14 The Employer must give prompt and genuine consideration to matters raised about thechange by the relevant Employees. 8.15 In this term "relevant Employees" means the Employees who may be affected by a changereferred to in subclause 8.1. Consultative Committee 8.16 The Company as part of its commitment to continuous improvement will within 3 months of employees covered Wood Offshore Maintenance Greenfields Agreement 7by tllis /l,greement being mobirised offshore will ~ue the initial Consultative Committee Meeting (0Jv1). 8.17 The makeup of the Consultative Committee will be designed to meet business requirements and provide coverage of the majority of Employees. The Consultative Committee shall include no more than three (3) elected Employee representatives per Offshore Facility and upto an equivalent number of management members. 8.18 The function of the committee is to: • Support cooperation between the Company and the Employees; • Encourage facilitation on high level employment related matters; and • Consult with Employees on any proposed major change. Consultative Committee Meetinq (CCM) 8.19 A CCM shall be held at an agreed frequency where management and the appointed Employee representatives can meet to discuss an agreed agenda. 8.20 Employee representative's attendance at these meetings will be at paid time at the applicable Onshore or Offshore Pay and if attended during the Off-duty Period will be paid asa meeting in accordance with Cl. 29. 8.21 Other than Employee wellbeing initiatives, issues relating to occupational health and safetyshall not be brought to the CCM. 8.22 Where requested, to communicate CCM outcomes a regular schedule of meetings between Employee representatives and Employees may be scheduled provided these meetings are ofno more than one hour per fortnight and are approved by the Client. Employee Representatives 8.23 The Employees will be responsible for the identification process of the appointed Employee representatives on the basis that it is a fair and reasonable process. An Employee elected asa 'Employee Representative' will be recognised by the Company once it is put forward by the Employee group. 8.24 An Employee representative subject to notifying their immediate supervisor shall be permitted reasonable time during working hours to carryout their representative role but shall not leave their place of work without first obtaining permission from their immediate supervisor. This sub-clause does not relieve the EmployeeRepresentative of any obligations or duties imposed on them by being an Employee of the Company. Emplovee Representative Traininq 8.25 Each calendar year, the Company will permit up to three (3) Employee Representatives per Offshore Facility to attend paid training time during their Off-duty Period for no more than three (3) x 7.6-hour days to assist the Employee Representatives to undertake their Employee Representative role. 8.26 The Company may assist arranging relevant training or relevant training may be organised bythe Employee Representative. Where the Company provides the training, the Company will pay for the cost of training and training time. Where the Employee organises their own appropriate training, the Company will pay training time only. Payment for training time will be as provided for in Cl 29. 8.27 Payment for relevant training in each calendar year will be made in the next pay period once reasonable evidence of attendance and applicable training time is provided. 9. DISPUTES SETTELMENT PROCEDURE 9.1 In the event of a dispute between the employer and an employee or employees about any matters arising under the Agreement, or in relation to the National Employment Standards, the dispute shall be dealt with in the following manner: 9.2 In th-e first instance, the dispute shall be taken up with the supervisor by the employee(s) Wood Offshore Maintenance Greenfields Agreement 8 by this Agreement being mobilised offshore will schedule the initial Consultative Committee Meeting (CCM). 8.17 The makeup of the Consultative Committee will be designed to meet business requirements and provide coverage of the majority of Employees. The Consultative Committee shall include no more than three (3) elected Employee representatives per Offshore Facility and upto an equivalent number of management members. 8.18 The function of the committee is to: . Support cooperation between the Company and the Employees; . Encourage facilitation on high level employment related matters; and Consult with Employees on any proposed major change. Consultative Committee Meeting (CCM) 8.19 A CCM shall be held at an agreed frequency where management and the appointed Employee representatives can meet to discuss an agreed agenda. 8.20 Employee representative's attendance at these meetings will be at paid time at the applicable Onshore or Offshore Pay and if attended during the Off-duty Period will be paid asa meeting in accordance with Cl. 29. 8.21 Other than Employee wellbeing initiatives, issues relating to occupational health and safetyshall not be brought to the CCM. 8.22 Where requested, to communicate CCM outcomes a regular schedule of meetings between Employee representatives and Employees may be scheduled provided these meetings are ofno more than one hour per fortnight and are approved by the Client. Employee Representatives 8.23 The Employees will be responsible for the identification process of the appointed Employee representatives on the basis that it is a fair and reasonable process. An Employee elected asa 'Employee Representative' will be recognised by the Company once it is put forward by the Employee group. 8.24 An Employee representative subject to notifying their immediate supervisor shall be permitted reasonable time during working hours to carryout their representative role but shall not leave their place of work without first obtaining permission from their immediate supervisor. This sub-clause does not relieve the EmployeeRepresentative of any obligations or duties imposed on them by being an Employee of the Company. Employee Representative Training 8.25 Each calendar year, the Company will permit up to three (3) Employee Representatives per Offshore Facility to attend paid training time during their Off-duty Period for no more than three (3) x 7.6-hour days to assist the Employee Representatives to undertake their Employee Representative role. 8.26 The Company may assist arranging relevant training or relevant training may be organised bythe Employee Representative. Where the Company provides the training, the Company will pay for the cost of training and training time. Where the Employee organises their own appropriate training, the Company will pay training time only. Payment for training time will be as provided for in Cl 29. 8.27 Payment for relevant training in each calendar year will be made in the next pay period once reasonable evidence of attendance and applicable training time is provided. 9. DISPUTES SETTELMENT PROCEDURE 9.1 In the event of a dispute between the employer and an employee or employees about any matters arising under the Agreement, or in relation to the National Employment Standards, the dispute shall be dealt with in the following manner: 9.2 In th-e first instance, the dispute shall be taken up with the supervisor by the employee(s) Wood Offshore Maintenance Greenfields Agreement 8concerned. 9.3 If the dispute is not satisfactorily resolved in accordance with subclause 9.2, the employee(s) shall approach the employer or its representative for discussion and/or negotiation regarding the matter. 9.4 If settlement cannot be reached through the above procedures, either of the parties may refer the matter to Fair Work Commission ('FWC') for conciliation. The parties agree that the best form of resolving the disputes is by conciliation. In using this method, the parties shall make every effort to achieve a successful outcome. 9.5 If the matter is not resolved by conciliation, then either of the parties may refer the matter to FWC for arbitration. The parties may identify a particular member of FWC who will arbitrate the matter in dispute and failing agreement on the selection of the member, it will be before a member allocated by FWC. In exercising its functions in this dispute resolution clause 9, FWC may exercise such procedural powers in relation to hearings, witnesses, evidence and submissions as are necessary to make the arbitration effective. 9.6 The decision of FWC in arbitration under this procedure may be appealed to a Full Bench of FWC. That appeal may be an appeal on a question of law and/or an appeal on the merits. The Full Bench may hear the appeal and exercise such powers in respect of the appeal as provided by the Act. 9.7 A decision of the FWC made pursuant to this clause 9 must not be inconsistent with the Code for the Tendering and Performance of Building Work 2016 (Building Code). 9.8 Employees may appoint a representative of their choice to assist in the resolution of the dispute at any or all of the stages of this procedure. The employee representative may be a shop steward, full time official of the Union, or any other person chosen by the employee. If the employee is represented by an official of the Union, meetings regarding the dispute must take place at premises other than where building work is performed. The venue must be convenient for all parties. 9.9 Whilst the above steps are being carried out the parties will ensure that work continues normally. 10. DISCIPLINARY PROCEDURE 10.1 The purpose of Wood Australia Disciplinary Procedure (Document HRM-PRO-100373) is to: a) Ensure all Employees are aware of the behaviours and standards expected of them at work. b) Inform Employees where they are not meeting the behaviours and standards expected of them, and the results of not complying. c) Provide Employees with the opportunity and support to meet workplace behaviours and standards. 10.2 The Employer will ensure to conduct any disciplinary or counselling process In accordance with the principles of procedural fairness and natural justice. Where an employee disputes the outcome of the disciplinary process the matter will be dealt with in accordance with the disputes settlement procedure. The FWC has the same powers and limitations as those contained in the dispute settlement procedure in this agreement. 10.3 An Employee may appoint a representative for the purposes of any counselling or disciplinary process, including appeals. If the employee is represented by an official of the Union, meetings must take place at premises other than where building work is performed. The venue must be convenient for all parties. 11. CONTRACT OF EMPLOYMENT Pre-emplovment Traininq and Inductions 11.1 Prior to or at the commencement of employment, candidates may be required to undertake pre employment training, verification of competency, medical examinations, drug and alcohol screening and demonstration of compliance with legislative requirements as part of the employment process. 11.2 As part of the onboarding process Employees may be required to undertake Client and or Company specified inductions, which may include an online component. Employees, who complete inductions as part of their preparation for mobilisation will be paid for inductions atthe Onshore Pay (as per Cl.29) provided they mobilise to the Offshore Facility. Types of Employment 11.3 The contract of employment for Full Time employees engaged as such, on an ongoing basis and is working a work cycle. 11.4 A Casual Employee will be engaged as such, by the shift and ongoing work is not guaranteed.A casual Employee will be paid the flat casual Hourly Rate of Pay provided for in SCH.1(1.4) for each hour worked. The casual Hourly Rate of Pay includes a loading paid as compensation for paid annual leave, paid personal/carer's leave, community service leave, notice of termination, redundancy benefits and public holidays not worked, and all other entitlements normally reserved for Full Time Employees. The casual loading is only payable for periods of employment in which an Employee is a casual Employee. A casual Employee will not be engaged to work a night shift onshore on a public holiday. A casual Employee will be paid no less than the total rates and allowances prescribed in the Hydrocarbons Industry (Upstream) Award plus 5% for any given pay period and if there are any changes to the Hydrocarbons Industry (Upstream) Award during the life of the Agreement the company will undertake an assessment to ensure compliance of the above commitment. Probation 11.5 Full Time Employee shall be employed subject to a probationary period of three (3) months unless the Company notifies the Employee in writing that a probationary period is not required. 11.6 During the probationary period the Employee's employment will be reviewed and assessed, and provided the Employee's performance is assessed as satisfactory, at the completion ofthe probationary period the Employee will be offered on-going employment. 11. 7 An Employee's regular service as a casual will count towards the fulfilment of the 11.8 probationary period should they convert from Casual to Full Time employment. Termination of Employment 11. 9 Either party may terminate the Employee's employment by giving the required notice period in writing or payment in lieu of notice except in the case of a summary dismissal. The required notice periods shall be: Casual I Casual Employee I Notice Period 12 hours Full Time Period of Continuous Service Notice Period Not more than 1 year 1 Week More than 1 year but not more than 3 years 2 Weeks More than 3 years but not more than 5 years 3 Weeks More than 5 years 4 Weeks 11.10 A Full Time Employee who at the time of being given notice, is over 45 years of age and who at the date of the termination has completed two years' continuous service with the Company, Wood Offshore Maintenance Greenfields Agreement 10 online induction completed in the candidate's own time, the Employee will receive payment for the Company allocated induction time to the applicable online learning moduleat the Onshore Pay. Company allocated time may be more or less than actual time taken, and no additional time will be paid. Calculation of Continuit y of Service 11.14 For the purpose of this clause continuity of service for Full Time Employees shall not bebroken where the Employee has been absent for taking a period of paid leave as defined within this agreement. Casual Emplo yee Riqht to Request Conversion to Permanent 11.15 A person engaged by the Company for a period no less than 12 months and is a regularCasual Employee may request that their employment be converted to Full Time. 11.16 A regular Casual Employee is a casual Employee who has in the preceding period of six (6) months worked a pattern of hours on an ongoing basis which, without significant adjustment,the Employee could continue to perform as a Full Time Employee under the provisions of this Agreement. Noting that a temporary demobilisation or a delayed mobilisation due to: • a cyclone; or • an emergency or pandemic situation, is not a significant adjustment to a regular pattern of hours for the purpose of assessing a Casual employee's eligibility to become Full Time. 11.17 Any request under this subdause must be in writing and provided to the Company. 11.18 Where a regular Casual Employee seeks to convert to Full Time employment, the Employer may agree to or refuse the request, but the request may only be refused on reasonable grounds and after there has been consultation with the Employee. 11.19 Reasonable grounds for refusal are limited to: a) it would require a significant adjustment to the Casual Employee's hours of work in order for the Employee to be engaged as a Full Time Employee in accordance with the provisionsofthis agreement - that is, the casual Employee is not truly a regular Casual Employee as defined in Cl. 11.15; b) it is known or reasonably foreseeable that the regular Casual Employee's position will cease to exist within the next twelve (12) months; c) it is known or reasonably foreseeable that the hours of work which the regular CasualEmployee is required to perform will be significantly reduced in the next twelve (12) months; or d) it is known or reasonably foreseeable that there will be a significant change in the days and/or times at which the Employee's hours of work are required to be performed in the next twelve ( 12) months which cannot be accommodated within the days and/or hours during which the Employee is available to work. 11.20 For any ground of refusal to be reasonable, it must be based on facts which are known or reasonably foreseeable. 11.21 Where the Employer refuses a regular Casual Employee's request to convert, the Employermust provide the Casual Employee with the Employer's reasons for refusal in writing within 21 days of Wood Offshore Maintenance Greenfields Agreement 11 shall be entitled to an additional week of notice from the Company. 11.11 Where an Employee is summarily dismissed by the Company, the Employee is not entitled to notice. 11.12 In calculating the payment in lieu of notice the Company shall pay the Employee the wagesand allowances they would have earned for the period of notice had their employment not been terminated. 11.13 If an Employee's employment is terminated, the Employee shall be provided with transportback to the Point of Hire. If the Employee does not accept the Employer's refusal,this will constitute a dispute that will be dealt with under the dispute settlement procedure inCI. 9 and the dispute level will be responded to in accordance with clause 9.4. 11.22 Where the Company refuses a regular Casual Employee's request to convert, the Employee will be permitted to make a subsequent request after a period of no less than six (6) months. 11.23 Where it is agreed that a Casual Employee will have their employment converted to Full Time employment as provided for in this clause, the Employer and Employee must discuss and record in writing the conversion. 11.24 The conversion will take effect from the start of the next pay cycle following such agreementbeing reached unless otherwise agreed. 11.25 Once a Casual Employee has converted to Full Time, the Employee may only revert to Casual employment with the written agreement of the Employer. 11.26 A c.asual Employee must not be engaged and re-engaged (which includes a refusal to re- engage), or have their hours reduced or varied, in order to avoid any right or obligation underthis clause. 11.27 Nothing in this clause obliges a regular casual Employee to convert to Full Time employment, nor permits an Employer to require a regular casual Employee to so convert. 11.28 Nothing in this clause requires an Employer to increase the hours of a regular casualEmployee seeking conversion to Full Time. 11.29 The Company must provide a casual Employee, whether a regular c.asual Employee or not,with a copy of the provisions of this clause within the first twelve (12) months of the Employee's first engagement to perform work. A copy of this Agreement provided by the Company to a Casual Employee will meet the obligations under this subclause. 11.30 A Casual Employee's right to request to convert is not affected if the Company fails to complywith the notice requirements in subclause 11.29. 11.31 Where any conversion takes place as provided for in this clause, any incorrectly paid loadingwill be recovered in accordance with Cl.30. 12. ROSTERED WORK HOURS AND WORK CYCLES Ordinary Hours of Work 12.1 The ordinary hours of work will be the average of up to 42 hours per week and may be averaged over a 52-week period. The ordinary hours for current established Work Cycles are detailed in sub-clause 12.6. Ordinarv Hours Allocation on Mobilisation and Demobilisation Shift 12.2 When an Employee (Full Time and Casual) works hours during travel days, the minimum allocation of ordinary hours between the mobilisation and demobilisation shift will be 12hours (one full shift). For the avoidance of doubt a day shift Employee (Full Time and casual) who arrives on the facility on their mobilisation shift at mid-day and work 6 hours that day, will be paid 6 hourswork plus travel payment. On the Employee's demobilisation shift of that Swing the Employee will receive a minimum of 6 hours worked plus travel payment regardless if they leave the facility before mid-day. A night shift Employee who arrives on the facility on their mobilisation shift and completes afull night shift of 12 hours; except for circumstances detailed in Clause 12.44 of this Agreement, shall receive no additional pay on their demobilisation shift as the Employee received 12 ordinary hours on their mobilisation shift. Offshore Shift Duration 12.3 Excluding hours worked by an Employee on a mobilisation or demobilisation shift the Rostered Hours of Work for an offshore day shift or Night Shift on the Offshore Facility shall be 12 hours per Wood Offshore Maintenance Greenfields Agreement 12 the request being made. Offshore Shift Duration 12.3 Excluding hours worked by an Employee on a mobilisation or demobilisation shift the Rostered Hours of Work for an offshore day shift or Night Shift on the Offshore Facility shall be 12 hours per Wood Offshore Maintenance Greenfields Agreement 12shift. However, an Employee may be required to work beyond the Rostered Hours of Work. Where an Employee works beyond the Rostered Hours of Work, the additionalhours will be treated and paid as Over Cycle. Work Cycles 12.4 Work on the Offshore Facilities is carried out on the basis of a Work Cycle consisting of an On-duty Period followed by an Off-duty Period. The On-duty Period working time may consist of ordinary hours, and if worked, Over Cycle. The Off-duty Period shall be an unpaid non- worked period in the form of rest and recreation (R&R) except as provided for in this Agreement. 12.5 Casual Employee ongoing engagements are not guaranteed. A Casual Employee may not complete a full Swing or may be asked to start a new Work Cycle prior to the completion of an Off-Duty Period. For the purpose of Over Cyde casual Employees will be assigned an On-duty period no longer than the On-duty Period undertaken by the Company's regular facility team (i.e. Cl.12.6a) or Cl.12.6b). 12.6 The current established Work Cycles are: a) 6-week Work Cycle (even time) of: • Mobilisation Shift (inclusive of day work or lx worked Night Shift) • 20 x worked day or night shifts • Demobilisation Shift (inclusive of day work or Night Shift demobilisation) • 20 x days Off-duty Period; consisting of a total of 252 offshore Rostered Hours of Work per completed Work Cycle. b) 4-week Work Cycle (even time) of: • Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) • 13 x worked day or night shifts • Demobilisation Shift (inclusive of day work or Night Shift demobilisation) • 13 x days Off-Duty Period; consisting of a total of 168 offshore Rostered Hours of Work per completed Work Cyde. c) 15-week Work Cycle ( 40% Roster) of: • Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) • 20 x worked day or night shifts • Demobilisation Shift (inclusive of day work or Night Shift demobilisation) • 27 x days Off-duty Period • Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) • 20 x worked day or night shifts • Demobilisation Shift (inclusive of day work or Night Shift demobilisation) • 34 x days Off-Duty Period; consisting of a total of 504 offshore Rostered Hours of Work per completed Work Cycle. d) 10-week Work Cycle ( 40% Roster) of: • Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) • 13 x worked day or night shifts • Demobilisation Shift (inclusive of day work or demobilisation) • 13 x days Off-duty Period Wood Offshore Maintenance Greenfie/ds Agreement 13shift. However, an Employee may be required to work beyond the Rostered Hours of Work. Where an Employee works beyond the Rostered Hours of Work, the additionalhours will be treated and paid as Over Cycle. Work Cycles 12.4 Work on the Offshore Facilities is carried out on the basis of a Work Cycle consisting of an On-duty Period followed by an Off-duty Period. The On-duty Period working time may consist of ordinary hours, and if worked, Over Cycle. The Off-duty Period shall be an unpaid non- worked period in the form of rest and recreation (R&R) except as provided for in this Agreement. 12.5 Casual Employee ongoing engagements are not guaranteed. A Casual Employee may not complete a full Swing or may be asked to start a new Work Cycle prior to the completion of an Off-Duty Period. For the purpose of Over Cycle Casual Employees will be assigned an On-duty period no longer than the On-duty Period undertaken by the Company's regular facility team (i.e. Cl.12.6a) or Cl.12.6b). 12.6 The current established Work Cycles are: a) 6-week Work Cycle (even time) of: Mobilisation Shift (inclusive of day work or 1x worked Night Shift) 20 x worked day or night shifts Demobilisation Shift (inclusive of day work or Night Shift demobilisation) 20 x days Off-duty Period; consisting of a total of 252 offshore Rostered Hours of Work per completed Work Cycle. b) 4-week Work Cycle (even time) of: Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) 13 x worked day or night shifts Demobilisation Shift (inclusive of day work or Night Shift demobilisation) 13 x days Off-Duty Period; consisting of a total of 168 offshore Rostered Hours of Work per completed Work Cycle. c) 15-week Work Cycle (40% Roster) of: Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) A 20 x worked day or night shifts Demobilisation Shift (inclusive of day work or Night Shift demobilisation) A 27 x days Off-duty Period Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) A 20 x worked day or night shifts A Demobilisation Shift (inclusive of day work or Night Shift demobilisation) 34 x days Off-Duty Period; consisting of a total of 504 offshore Rostered Hours of Work per completed Work Cycle. d) 10-week Work Cycle (40% Roster) of: Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) 13 x worked day or night shifts A A Demobilisation Shift (inclusive of day work or demobilisation) 13 x days Off-duty Period A Wood Offshore Maintenance Greenfields Agreement 13 • Mobilisation Shift (inclusive of day work or 1 x worked Night Shift) • 13 x worked day or night shifts • Demobilisation Shift (inclusive of day work or demobilisation) • 27 x days Off-Duty Period; consisting of a total of 336 offshore Rostered Hours of Work per completed Work Cycle. 40% Roster Make Up Days for Full Time Employees 12. 7 In circumstances where a Full Time Employee works a 40% Roster as detailed in subclause 12.6 c) and d) above or variations of, in each following 12 months of continuous service working the roster those Employees shall be required to attend a minimum of 76 paid hours (make up days) of: • onshore training as provided for in Cl.29 of this Agreement; or • onshore alternative duties (with 8 weeks' notice or as otherwise agreed); during the Employee's Off-Duty Period. 12.8 On the 12-month anniversary after undertaking the 40% Roster, any outstanding balance ofthe 76 hours which have not been requested by the Company, will be paid out to the FullTime Employee at the Onshore Pay in the next available pay period. 12.9 In circumstances where the Company request an Employee to undertake training or alternative work and the Employee is unable to attend, including circumstances where theEmployee is on leave, those requested hours will be deducted from the guaranteed days balance. 12.10 In circumstances where the Company changes the Full Time Employee's Work Cycle from a40% Roster to an even time roster or the Employee is terminated by way of redundancy,training hours will be calculated on a pro-rata basis and outstanding hours will be paid out. 12.11 In circumstances where the Full Time Employee's employment is terminated for reasonsother than redundancy, any outstanding training hours will not be paid out. 12.12 At any time while working the 40% Roster a Full Time Employee is able to submit a payroll query as detailed in subclause 30.3 and will be provided the balance of outstanding hours tobe worked in a given 12-month period. Standb y 12.13 In circumstances where an Employee (Full Time or casual) has been demobilised to the Point of Assembly and is held there during an On-Duty Period, except as stated elsewhere inthis Agreement, the Employee will be paid their Rostered Hours of Work at the Onshore Pay. 12.14 In circumstances where a Full Time Employee is unable to mobilise or has been demobilisedto their Point of Hire or Perth and is held there during an On-Duty Period, except as stated elsewhere in this Agreement (e.g. make-up hours, flight delays), the Employee will be paid 7 .6 hours for each On-duty rostered shift at the Onshore Pay. Should a Full Time Employeebe on standby for an entire Swing, the demobilisation shift will be unpaid. 12.15 In lieu of a 'standby', the Company may require an Employee to undertake onshore trainingor alternative duties where the Employee will be paid at the Onshore Pay. For clarity, any paid hour for training or alternative duties is paid in lieu of a paid hour for standby as provided for in subclause 12.13 or 12.14 and should the alternative training/work not coverthe duration of standby hours, the Employee will be paid the outstanding hours depending where the training/alternative duties take place. Make-Up Hours 12.16 In circumstances where a Full Time Employee is unable to work the regular Work Cycle dueto numbers of people on board the Offshore Facility or as provided for elsewhere in this Agreement (e.g. stand down, personal leave, missed flights), the Company may reschedule missed rostered hours as 'make-up hours' in the following 18 week period inclusive of thecurrent Work Cycle. 12.17 Where a situation arises where work is not being made available to Full Time Employeesbecause of Wood Offshore Maintenance Greenfields Agreement 14 a circumstance in subclause 12.16 the following guiding principles will be followed by the Company: a) A selection process of each impacted classification will be undertaken where the Company identifies: • casual Employees working in the current/impacted Swing; • Full Time Employees undertaking Over Cycle shifts in the current /impacted Swing; • Full Time Employees who have undertaken more than 5 Over Cycle shifts in the preceding 18- week period; and the Company considers whether those Employees should be impacted prior to any impact on other Full Time Employees; and b) Full Time Employees will not be asked to miss more than 22 shifts of scheduled work per calendar year; and c) Except for where urgent operational or emergency reasons impacting the manning on thefacility Employees will be provided with at least 14 days of notice that they will miss scheduled hours. 12.18 In circumstances where a shutdown is scheduled or it becomes known that a Full Time Employee's usual Work Cycle will be impacted, the Company may schedule advanced make-up hours within the 18-week period preceding the shutdown or period occurring. 12.19 Where the expected event in subclause 12.18 above does not occur, Full Time Employees who have undertaken make-up hours will return to their usual roster and any additional hoursworked will be paid and treated as Over Cycle. In circumstances where a Full Time Employeehas made other commitments and is not available to return to their usual roster, the Employee can choose not to work provided they advise the Company as soon as practicable. 12.20 Make-up hours will include: • Offshore work in addition to the usual Work Cycle; or • Onshore training Make-up hours will not include work outside the coverage of this Agreement 12.21 Make-up hours will be treated and paid as ordinary hours at the Offshore Pay rate and will not be treated and paid as Over Cycle. 12.22 Excluding circumstances stated in this Agreement (i.e. stand down, personal leave, missedflights), where a Full Time Employee has not been offered enough hours of work by the Company to meet the rostered hours in the following 18-week period, the Employee will be paid the outstanding hours in the next available full pay period. 12.23 Full time Employees will make themselves available to undertake make-up hours during theirOff duty Periods. Where the Employee informs the Company that they are not available within the 18-week period the Employee forfeits those hours except in exceptional circumstances as approved by the Company. Work Cycle Chanqe 12.24 Except in Emergency or Pandemic Situations the Company may introduce a roster change after it has provided a full Work Cycle of notice to Employees and has consulted with affected Employees in accordance with the Consultation Clause 8 of this Agreement as may be necessary about such a Work Cycle change. 12.25 Except in Emergency or Pandemic Situations, the Company will not introduce a new Work Cycle where the On-duty Period is more than 22 shifts (excluding mobilisation and demobilisation days) worked in a row unless the Company has agreement with the majority ofaffected Employees at the time of the roster change. 12.26 In the case of an Emergency or Pandemic Situation the Company may vary or suspend anyroster arrangement immediately. In circumstances where the Company introduce a new Work Cycle to Wood Offshore Maintenance Greenfields Agreement 15 a circumstance in subclause 12.16 the following guiding principles will be followed by the Company: a) A selection process of each impacted classification will be undertaken where the Company identifies: Casual Employees working in the current/impacted Swing; . Full Time Employees undertaking Over Cycle shifts in the current /impacted Swing; . Full Time Employees who have undertaken more than 5 Over Cycle shifts in the preceding 18- week period; and the Company considers whether those Employees should be impacted prior to any impact on other Full Time Employees; and b) Full Time Employees will not be asked to miss more than 22 shifts of scheduled work per calendar year; and c) Except for where urgent operational or emergency reasons impacting the manning on thefacility Employees will be provided with at least 14 days of notice that they will miss scheduled hours. 12.18 In circumstances where a shutdown is scheduled or it becomes known that a Full Time Employee's usual Work Cycle will be impacted, the Company may schedule advanced make-up hours within the 18-week period preceding the shutdown or period occurring. 12.19 Where the expected event in subclause 12.18 above does not occur, Full Time Employees who have undertaken make-up hours will return to their usual roster and any additional hoursworked will be paid and treated as Over Cycle. In circumstances where the Company introduce a new Work Cycle to Wood Offshore Maintenance Greenfields Agreement 15manage an Emergency or Pandemic Situation: • the new roster will remain in place whilst the Company can demonstrate that theroster is required due to the Emergency or Pandemic situation. • the new roster On-duty Period on the facility will not exceed 28 consecutive shifts excluding demobilisation shifts. For the avoidance of doubt an onshore quarantineperiod may occur as part of the Off-Duty period. 12.27 The on-duty hours of work for an Employee working Offshore will commence when the Employee has arrived at the Offshore Facility and commenced their allocated rostered workhours. On-duty hours of work will cease when the Employee completes their designated rostered work hours prior to departing the Offshore Facility. 12.28 Travel time, including any time the subject of any payment provided for in Cl.15, shall not be regarded as working time. Over Cycle 12.29 Except as noted in this Agreement, any hours or shifts worked offshore in addition to the designated Rostered Hours of Work will be regarded as Over Cycle. Over Cycle hours will bepaid as according to the tables in SCH 1(1.3) and SCH 1(1.5). The Company may require Employees to work Over Cycle to meet operational requirements. 12.30 Where an Employee working a 40% Roster completes their On-duty Period and is required tostay back and work an additional shift, those additional hours worked above the Rostered Hours of Work (e.g. above 504 hrs) will be regarded as Over Cycle. 12.31 Where an Employee completes an On-duty Period, and prior to completing the Oft-Duty period starts a new On-duty Period (except as detailed in subclause 12.32 below), provided the Employee has at least 7 days of Oft-duty Period; those hours will not be regarded as OverCycle. In circumstances where an Employee completes an On-duty Period, and prior to completing the Oft-duty Period starts a new On-duty Period, the Employee should have no less than 7 days (excluding mobilisation and demobilisation days) oft-duty. Where the Employee has lessthan 7 days oft-duty (excluding mobilisation and demobilisation), those days worked up until 7 days after the previous demobilisation day will be regarded as Over Cycle. Casual Maximum Allocated Ordinarv Hours 12.32 Over the course of a year and as provided in the paragraph below, where a Casual Employee works ordinary hours in excess of the maximum allocated ordinary hours (2184 hours), thoseadditional worked hours will be regarded as Over Cycle. Hours that are not ordinary such as Over Cycle and additional hours during the Off-duty Period, are not included in the calculation of the maximum allocated ordinary hours. On the 12-month anniversary of a casual Employee's engagement the Company will review the number of ordinary hours worked over the previous 12 months. In circumstances wherethe Employee has worked ordinary hours in excess of the maximum allocated rostered ordinary hours (2184 hours over a 52 week period), excess ordinary hours will be regarded as Over Cycle and any shortfall will be paid to the Employee in the next available full pay period. Where excess ordinary hours are back paid as Over Cycle, the Company will correct the corresponding overpayment of the superannuation contribution. This sub-clause is effective from the Agreement's commencement meaning that a Casual Employee employed at the time this Agreement commences, their 12-month anniversary date will be the Agreement commencement date. Additional Time Not Paid as Over Cycle 12.33 The following additional time outside the Work Cycle will not be paid as Over Cycle: • Make-up hours. • Where the Company implements a once off change to the Work Cycle to facilitate Wood Offshore Maintenance Greenfields Agreement 16 manage an Emergency or Pandemic Situation: the new roster will remain in place whilst the Company can demonstrate that theroster is required due to the Emergency or Pandemic situation. the new roster On-duty Period on the facility will not exceed 28 consecutive shifts excluding demobilisation shifts. Where the Company implements a once off change to the Work Cycle to facilitate Wood Offshore Maintenance Greenfields Agreement 16Employees to not have to work two consecutive Christmas/ New Year periods. • Shift swap arrangements organised privately between the Employees themselves. • Time associated with safety drills or routine musters. • Time associated with travel as detailed in Cl. 15 of this Agreement. • Time attending training, meetings or medicals as detailed in Cl. 29 of this Agreement. • Annual leave scheduled over the Off-duty Period. Rest and Meal Breaks 12.34 Employees shall be paid for time worked offshore at the appropriate Offshore Pay inclusive ofrest and meal breaks occurring during a shift, which shall be counted as time worked. 12.35 Rest and meal breaks shall be aligned to Client operational requirements which may include: • Two (2) separate 30-minute meal breaks; or • Three (3) separate breaks consisting of a 15-minute rest break, 30-minute meal break and a 15-minute rest break; or • An equivalent alternative rest and meal break pattern encompassing one (1) hour rest and mealtime. 12.36 The aforementioned breaks do not include the time required to wash up prior to Employees commencing a meal or rest break. 12.37 An Employee shall not be required to work longer than six (6) hours without a break. Call Backs 12.38 An Employee recalled to work after the completion of their Rostered Hours of Work for that shift will be paid Over Cycle and shall be paid a minimum of four ( 4) hours pay, except wherethe additional work is continuous with the rostered hours, whereby the Employee will be paid for the additional hours worked at the relevant Over Cycle rate. 12.39 Where an Employee is required to work outside the Employee's Rostered Hours of Work, thework shall, unless agreed with the Employee, be arranged so that the Employee has at least 10 consecutive hours off-duty between completion of work and the commencement of the next rostered shift without loss of pay. 12.40 For the purpose of subclause 12.38 and 12.39, musters or safety drills are not consideredcall out situations and are not paid work time. Mobilisation Delays 12.41 Where an Employee is required to mobilise to the Offshore Facility and their flight is unexpectedly delayed at the Point of Assembly or the Point of Hire through no fault of their own, the Employee will be paid the hours they would have worked had they not been delayedat the Offshore Pay. 12.42 Where an Employee is required to stay overnight at the Point of Assembly or in transit (i.e.Perth for interstate Employees) due to a delay under subclause 12.41 the Company shall provide accommodation and meals for the Employee as well as transportation to and fromthe accommodation. 12.43 Where an Employee is required to stay overnight due to a delay under subclause 12.41 at thePoint of Hire and their Usual Place of Residence is outside 100km from the Point of Hire, theEmployee shall be provided accommodation only. Niqht Shift Demobilisinq De/a v. 12.44 Where an Employee (Full Time or Casual) is demobilising from the Offshore Facility after completing their last Night Shift and the demobilising helicopter leaves the facility 6 hours after the last Night Shift concludes, the Employee shall receive an additional 4 hours paid asOver Cycle. Wood Offshore Maintenance Greenfields Agreement 17 Employees to not have to work two consecutive Christmas / New Year periods. Shift swap arrangements organised privately between the Employees themselves. Time associated with safety drills or routine musters. Time associated with travel as detailed in Cl. 15 of this Agreement. Time attending training, meetings or medicals as detailed in Cl. 29 of this Agreement. . Call Backs 12.38 An Employee recalled to work after the completion of their Rostered Hours of Work for that shift will be paid Over Cycle and shall be paid a minimum of four (4) hours pay, except wherethe additional work is continuous with the rostered hours, whereby the Employee will be paid for the additional hours worked at the relevant Over Cycle rate. 12.39 Where an Employee is required to work outside the Employee's Rostered Hours of Work, thework shall, unless agreed with the Employee, be arranged so that the Employee has at least 10 consecutive hours off-duty between completion of work and the commencement of the next rostered shift without loss of pay. 12.40 For the purpose of subclause 12.38 and 12.39, musters or safety drills are not consideredcall out situations and are not paid work time. Mobilisation Delays 12.41 Where an Employee is required to mobilise to the Offshore Facility and their flight is unexpectedly delayed at the Point of Assembly or the Point of Hire through no fault of their own, the Employee will be paid the hours they would have worked had they not been delayedat the Offshore Pay. 12.42 Where an Employee is required to stay overnight at the Point of Assembly or in transit (i.e.Perth for interstate Employees) due to a delay under subclause 12.41 the Company shall provide accommodation and meals for the Employee as well as transportation to and fromthe accommodation. 12.43 Where an Employee is required to stay overnight due to a delay under subclause 12.41 at thePoint of Hire and their Usual Place of Residence is outside 100km from the Point of Hire, theEmployee shall be provided accommodation only. Night Shift Demobilising Delav. 12.44 Where an Employee (Full Time or Casual) is demobilising from the Offshore Facility after completing their last Night Shift and the demobilising helicopter leaves the facility 6 hours after the last Night Shift concludes, the Employee shall receive an additional 4 hours paid asOver Cycle. Wood Offshore Maintenance Greenfields Agreement 1712.45 Where it is determined by the Company that the Employee finishing their last Night Shift will not be able to depart the Offshore Facility that following day, the Employee will be provided a cabin and return to working their night shift pattern provided they have met the minimum rest period as per subclause 13.5. Where this occurs the payment in subclause 12.44 will not apply. Roster Swing Panel Change 12.46 Where a Full Time Employee is required to change to a different Swing panel, the change applied will not financially disadvantage the Full Time Employee for the difference in hoursworked due to the change within that change period. 13. SHIFT WORK AND NIGHT SHIFT Shift Workers 13.1 All Employees employed pursuant to this clause are deemed to be shift workers. A shift worker means an Employee for the time being required by the Employer to work in a systemof shifts, being day shifts or Night Shifts or any combination of them; or Continuous Shift Work. Payment 13.2 The following shall be paid for Employee's working shift work: • An Employee working day shift will be paid the applicable hourly rate of pay for each hour of day shift worked as detailed in Schedule 1. • An Employee working Night Shift will be paid the applicable Night Shift hourly rate of pay as detailed in Schedule 1. For avoidance of doubt, the Night Shift hourly rate of pay is only paid when the Employee is working Night Shift and is not paid when the Employee is not working Night Shift such as additional day shift Over Cycle, delays, travel or periods of leave. 13.3 Employees will be rostered to a day or Night Shift and may be transferred from one toanother as operational demands require. The Employer will give 24 hours' notice for achange of roster to either day shift or Night Shift. 13.4 Where an Employee is changed between Night Shift and day shift within an On-duty Period,the Employee will not lose hours for that On-duty Period. For the avoidance of doubt thissubclause is in regard to missed hours worked and those missed hours are paid at the day shift hourly rate of pay. 13.5 Employees will be given eight (8) hours' rest time in their cabin upon arrival at the Offshore Facility prior to starting Night Shift. This may be varied upon mutual agreement. If the restperiod does not allow the Employee to start at the commencement of the normal shift theEmployee will be paid as if the entire 12-hour shift was worked. 13.6 In circumstances where the Company changes the shift start and finish times to fall between 11am/11pm to 1am/1pm, with the view to Employees receiving the Night Shift hourly rate ofpay when it is night time; instead of the Night Shift rate of pay being paid on all night shift hours as provided for in subclause 13.2 and excluding Over Cycle hours worked in addition toa day shift; the Night Shift hourly rate of pay will be paid on any hour worked between 6pm and 6am. 14. FITNESS FOR WORK Druq and Alcohol Breaches 14.1 The Company is committed to ensuring a safety culture where Employees are not impactedby drugs or alcohol while at work. While at work Employees are required to disclose any substances they are taking which may impact the safe performance of their work to the facility medic. 14.2 Employees may be required to undertake drug and/or alcohol (D&A) tests for fitness for duty: • while working; • at the commencement of/during travel to the Offshore Facility; Wood Offshore Maintenance Greenfields Agreement 18 12.45 Where it is determined by the Company that the Employee finishing their last Night Shift will not be able to depart the Offshore Facility that following day, the Employee will be provided a cabin and return to working their night shift pattern provided they have met the minimum rest period as per subclause 13.5. The form and manner of such assessments or tests will be at the discretion of the Company. 14.3 Where an Employee is found to have refused to undertake a drug and/or alcohol test; or received a positive screening for the consumption of alcohol or illicit/unprescribed drugs, the Employee's actions will be regarded as gross misconduct which will result in disciplinary action up to termination of employment. Fatigue Manaqement 14.4 The management of fatigue is considered a shared responsibility between the Company andits Employees. 14.5 The Company will cultivate and support a culture of fatigue risk management in which personnel are comfortable in disclosing their personal sleep and fatigue status, and whereseeking assistance is encouraged, consistent with the Company protections afforded to report other safety concerns/risks. 14.6 Employees are responsible for attending work in a fit state (fitness for work) by taking into account their lifestyle and medical factors that could influence fatigue and managing theseappropriately. All Employees are responsible for ensuring they obtain adequate rest and sleep prior to travelling to Offshore Facilities or travelling home from their Point of Hire. 14.7 Subject to the provision of a journey management plan, demobilising Employees who have a Usual Place of Residence more than 100km from their Point of Hire, and are driving home as part of their immediate journey and not claiming a taxi as provided in the subclause below,will be offered accommodation at no cost to the Employee, in either Karratha or Perth prior to returning to their Usual Place of Residence. 14.8 Employees are entitled to claim a taxi/ride share reimbursement of up to $212.50 per Swing (one payment per On Duty period) for travel between their Usual Place of Residence and theirPoint of Hire on provision of a tax invoice from a licensed taxi provider ( or other ride sharing service if not subject to fringe benefit tax). For avoidance of doubt, travel claims which are not for travel between work and the Employee's nominated Usual Place of Residence or are not undertaken by a licensed taxi provider/ ride sharing service are not to be submitted for claim without prior Company authorisation. The taxi reimbursement maximum value permitted will increase by $12.50 after the first fullpay period after 1 July each year up to the maximum of $250 in the final year of the Agreement term. 14.9 Claims for a Swing must be submitted as a single submission and within 6 weeks oftheSwing demobilisation date for the claim to be approved. 15. TRAVEL Point of Hire and Point of Assembly 15.1 The Point of Hire and Point of Assembly for Employees shall be determined uponemployment. 15.2 The Company shall provide the Employee with flight transport between the Point of Hire, thePoint of Assembly, and the Offshore Facility. 15.3 The Company shall provide an Employee who has a Point of Hire as Karratha with flight transport where the employee is required to travel to or from Perth for work related purposesas provided for in Clause 29 of this Agreement. 15.4 An Employee may request to change their Point of Hire between the available locations as stipulated by the Company. Approval to change a Point of Hire will be at the discretion of the Company. For the avoidance of doubt, it is not the Company's practice to approve requests where the change will increase the cost of travel offered to the Employee. Travellin g Pa yment Wood Offshore Maintenance Greenfields Agreement 19 at the commencement of/during onshore training; .during periodic medical assessments. Travelling Payment Wood Offshore Maintenance Greenfields Agreement 1915.5 Employees whose Point of Hire is Karratha shall not receive a payment for travel to/from thePoint of Hire to or from the Point of Assembly. 15.6 Employees whose Point of Hire is not Karratha will receive a payment of two (2) hours' pay at the Onshore Pay for travel between the Point of Hire and the Point of Assembly. 15. 7 Employees whose Point of Hire is Karratha will receive a payment of two (2) hours paid at the Onshore Pay for travel between the Point of Hire and Perth should the Employee be required to travel to/from Perth for training or on a working requirement. 15.8 Employees will receive a payment of one (1) hour paid at the Offshore Pay each time the Employee travels to and from the Point of Assembly and the Offshore Facility. A paid helicopter journey includes a flight which is longer than one hour should the flight be turnedaround. 15.9 In this Agreement where Employees are paid their rostered hours (e.g. Compassionate LeaveCl.20) and are travelling, the paid hours will be in lieu of the travel payment. Missed Fliqhts 15.10 Where an Employee has missed a flight for reasons within the Employee's control, the Company will endeavour to have the Employee mobilised at the first available opportunity. Incircumstances where a Full Time Employee is unable to be mobilised, the Employee will beentitled to take annual leave if available or unpaid leave until they are mobilised. In circumstances where a casual Employee is unable to be mobilised due to logistical or operational reasons, they will not be entitled to payment. 15.11 An Employee who has missed a flight for reasons within the Employee's control will be subject to the warnings provided for in counselling and disciplinary process in Cl.10 of thisAgreement. 16. REDUNDANCY AND SEVERANCE Redundancy 16.1 Employees covered by this Agreement shall be paid no less than the redundancy entitlementsin the NES and the subclauses below are intended to supplement this entitlement. 16.2 Prior to implementing any reductions to Full Time positions the Company will first terminate ongoing casual positions of the same impacted classifications except in cases where a casual Employee has a specific competency or skill set outside of their designated classification which is required to be utilised as part of their role (eg. rope access) which FullTime Employees of the same classification could not attain in a reasonable time frame or at reasonable cost. Consultation 16.3 Where the Company has made the decision that a Full Time Employees job is no longer to be performed and that decision may lead to termination of employment, the Company shall consult with relevant parties as required by the Act, the Agreement and with CCM representatives. 16.4 The Company will communicate in the following way regarding possible down manning/ redundancy decisions: • Prior to any terminations due to redundancy the relevant CCM representatives will be informed; and • The Company will consider proposals to avoid or minimise terminations and the adverse effect the terminations on the Employees concerned. Transfer to Lower Paid Duties 16.5 Where there is agreement between the Company and an Employee to transfer a Full Time Employee to lower paid duties for reasons set out in subclause 16.3, the Employee shall be entitled to the same period of notice of transfer as the Employee would have been entitled to had the Employee's employment been terminated. The Company may choose to make payment in lieu thereof of an amount equal to the difference between the former ordinary weekly rate of wage and the new lower ordinary weekly rate of wage for the number of weeks of notice still owing. Wood Offshore Maintenance Greenfields Agreement 20 15.5 Employees whose Point of Hire is Karratha shall not receive a payment for travel to/from thePoint of Hire to or from the Point of Assembly. 15.6 Employees whose Point of Hire is not Karratha will receive a payment of two (2) hours' pay at the Onshore Pay for travel between the Point of Hire and the Point of Assembly. 15.7 Employees whose Point of Hire is Karratha will receive a payment of two (2) hours paid at the Onshore Pay for travel between the Point of Hire and Perth should the Employee be required to travel to/from Perth for training or on a working requirement. 15.8 Employees will receive a payment of one (1) hour paid at the Offshore Pay each time the Employee travels to and from the Point of Assembly and the Offshore Facility. Wood Offshore Maintenance Greenfields Agreement 20Severance Accrual Pa yment 16.6 For a Full Time Employee, a weekly severance payment of two (2) hours paid at the Day ShiftBase Hourly Rate of Pay for every completed week of continuous service (i.e. the On-Duty period and the Off-duty Period counts as continuous service for the purposes of this clause) will be paid into a Redundancy Trust Fund (RTF). 16. 7 The severance payment will continue to be paid for all periods of paid leave however it willnot be paid for part worked weeks, unpaid leave or unauthorised absence. 16.8 The Redundancy Trust Fund (RTF) agreed by the Parties is Protect and will remain in place until the Agreement is replaced or terminated. 16.9 Should an RTF be determined, the Company will pay into the RTF on no less than a monthly basis. 16.10 When a Full Time Employee's employment is terminated, at the time of termination the Company shall: • Provide the RTF "certificate of employment" to the Employee with the Employee's termination payment, within five (5) working days of the termination; • Ensure all contributions owing to the RTF in relation to the Employee are paid up to date; and • Complete a certificate of employment form provided by the RTF to certify the length of the Employee's employment with the Company and send to the form to the RTF within 5 working days of termination. 16.11 The RTF payment shall be deemed to be inclusive of tax payments (if any) required to bepaid in relation to Fringe Benefit taxation. 16.12 If a Full Time Employee's employment is terminated by the Company on the grounds of redundancy and the Employee would otherwise be entitled to redundancy pay under the Act, the Company will pay the Employee a redundancy pay that equals the amount the Company is obliged to pay pursuant to the Act less any credits that have been made to the Employee'sRTF. If the Company's obligation in relation to redundancy pursuant to the Act is equal to orless than the credit in the Employee's RTF, then the Company shall not be liable for any further payments in relation to it redundancy obligation under the Act. 16.13 This clause does not apply to casual Employees. 17. SUPERANNUATION 17.1 In accordance with the requirements of the Superannuation Guarantee (Administration) Act 1992 ("SG Act") the Company shall make the required contribution on the Rostered Hours ofWork for each eligible Employee to the individual Employee's choice of superannuation fund provided that the fund will allow contributions from the Company and is a complying fundunder the SG Act. For avoidance of doubt, superannuation for each Employee is not paid onOver Cycle or additional hours which are not ordinary time and paid up to the maximum Superannuation contribution base. 17.2 In the event an Employee does not nominate a fund the Company shall make contributions to the Employee's stapled fund identified to the Company by the ATO. If the Employee does not choose a fund and if there is no stapled fund for the Employee, the Company will make contributions for the Employee to the Company's default fund specified in the standard choice form, "Australian Super" provided Australian Super offer a MySuper product. 17.3 Permanent and Casual Employees may elect to sacrifice part of their gross ordinary pay intotheir superannuation fund subject to the conditions of this clause. 17.4 Employees must notify the Company in writing of the amount of their gross ordinary pay which they wish to sacrifice into superannuation and the Company will then act upon thisrequest. 17.5 If the rate of superannuation contributions required under the SG Act is increased during theterm of this Agreement or is otherwise increased by the Company, Employees under this Agreement Wood Offshore Maintenance Greenfields Agreement 21will be entitled to the increased contribution. 18. INCOME PROTECTION INSURANCE Available to Full Time and Casual Emplovees 18.1 The Company shall provide income protection (IP) Insurance for all employees covered by this agreement. The Employer will appoint Chifley Services as broker to source the policy. The IP will commence within 1 month from the date the first employees covered by the Agreement have mobilised offshore. 18.2 The insurance policy will provide the following as a minimum: a) A maximum 14 day waiting period; and b) Cover for 100% of income up to a maximum of $2,300 per week for 104 weeks. 18.3 The company will not be required to contribute greater premiums than 2% of the individuals' wages per week for such insurance during the life of the Agreement. Where the company is unable to obtain the above level of cover due to the Insurer loss ratio, the Company and Consultative Committee will work together with Chifley services on the level of coverage available from alternate providers while maintaining the maximum 2% premium. 19. PERSONAL LEAVE (SICK/CARER'S) Sick While on Offshore 19.1 An Employee who is on the Offshore Facility, who is unable to attend work due to illness or is deemed unfit for work as instructed by the Offshore Facility medic will continue to be paid their Rostered Hours of Work as if they are at work at the Offshore Pay. 19.2 On assessment and as instructed by the Offshore Facility medic, installation manager or their delegate, an Employee may be demobilised from the Offshore Facility. On leaving the Offshore Facility the Employee will no longer be paid for their Rostered Hours of Work and may access their personal leave entitlements. 19.3 Employees who are unable to commence mobilisation or travel to the Offshore Facility due to illness or fitness for work will be entitled to take personal leave as provided for in this clause. Entitlement to Personal Leave 19.4 A Full Time Employee is entitled to progressively accrue 10 days' paid personal leave overeach 12 months of service (one (1) day per 5.2 weeks of service) as provided for in the NES. 19.5 Personal leave may be taken by an Employee who is absent from work; due to a personalillness, injury (other than that covered by Workers' Compensation); or to provide care or support to a member of the Employee's immediate family or a member ofthe Employee's household who requires care or support because of the member's illness or injury or an unexpected emergency affecting the member. 19.6 Full Time Employees entitled to take a period of personal leave will be paid in that period the Employee's Onshore Pay for the Rostered Hours of Work. 19.7 An Employee (including a Casual Employee) is entitled to two (2) days of unpaid carer's leave (subject to the below notice and evidence requirements) for each occasion when a member ofthe Employee's Immediate Family, or a member of the Employees' household requires careor support because of a personal illness, or personal injury, affecting the member, or an unexpected emergency affecting the member. 19.8 An Employee (excluding Casual Employees) cannot take unpaid carer's leave during a periodif the Employee could instead take paid personal/carer's leave. 19.9 Untaken personal/carers leave accumulates from year to year but is not paid out upontermination of employment. Takinq Personal Leave Wood Offshore Maintenance Greenfields Agreement 22 will be entitled to the increased contribution. 18. Taking Personal Leave Wood Offshore Maintenance Greenfields Agreement 2219.10 To be entitled to personal leave an Employee must provide the Company notice that the Employee is or will be absent from work as soon as reasonably practicable. This should ideally be prior to mobilisation or the shift commencing. The notice must explain the reasonfor the Employee's inability to attend work and estimated duration of absence. 19.11 For personal leave greater than two (2) days' duration or as requested by the Company the Employee shall provide documentary evidence in the form of a medical certificate or statutory declaration to support their absence unless otherwise approved by the Company. 19.12 An Employee returning after a period of illness or Injury, once assessed as fit to return towork, will be mobilised at the first available opportunity. 19.13 In circumstances where a Full Time Employee is unable to be mobilised due to: • unavailable flights; or • unavailable beds on the facility; or • the Full Time Employee is within 5 days before the end of their Swing following a period of personal leave, the Full Time Employee will be entitled to take further personal leave if available, annual leave if available or unpaid leave until they are mobilised,or they have completed their Swing. 19.14 In circumstances where the Full Time Employee is unable to be mobilised for any reason other than those detailed in the subclause above, any On-duty hours of work missed after 24hour from the Employee being declared fit to return to work will be need to be made up as provided for in subclause 12.16 of this Agreement or paid as standby as provided for in subclause 12.14. Takinq personal leave during a notice period 19.15 The Employee will be entitled to take sick/carers leave during a worked notice period of termination if the term is covered by a medical certificate. 20. COMPASSIONATE LEAVE 20.1 On the provision of satisfactory evidence, a Permanent Employee shall be entitled to a period of two (2) days' compassionate leave and up to (2) days travel as per subclause 20.2 for each occasion when a member of the Employee's Immediate Family, or member of the Employee's household: • contracts or develops a personal illness that poses a serious threat to his or her life; or • sustains a personal injury that poses a serious threat to his or her life; or • dies. 20.2 Where a Full Time Employee qualifies for compassionate leave under this clause and is working Offshore at the time they are made aware of the death or near death of ImmediateFamily or household member; the Employee will receive their rostered hours for the travel day in lieu of the travel payment. If the Employee is returning to the Offshore Facility after taking their entitlement, the Employee will receive their rostered hours for the travel day paid at the applicable Offshore and Onshore pay. 20.3 Payment in respect of compassionate leave is to be made only where the Employee otherwise would have been on duty and shall not be granted in cases where the Employee would have been off-duty in accordance with the applicable Work Cycle, or on annual leave, personal leave, authorised absence, long service leave, workers compensation, or leave without pay. 21. JURY SERVICE 21.1 Jury Service will be paid as per the Western Australian Juries Act 1957 or any otherlegislation that takes its place. Notice and Evidence Required Wood Offshore Maintenance Greenfields Agreement 23 19.10 To be entitled to personal leave an Employee must provide the Company notice that the Employee is or will be absent from work as soon as reasonably practicable. This should ideally be prior to mobilisation or the shift commencing. The notice must explain the reasonfor the Employee's inability to attend work and estimated duration of absence. 19.11 For personal leave greater than two (2) days' duration or as requested by the Company the Employee shall provide documentary evidence in the form of a medical certificate or statutory declaration to support their absence unless otherwise approved by the Company. 19.12 An Employee returning after a period of illness or Injury, once assessed as fit to return towork, will be mobilised at the first available opportunity. 19.13 In circumstances where a Full Time Employee is unable to be mobilised due to: · unavailable flights; or . unavailable beds on the facility; or the Full Time Employee is within 5 days before the end of their Swing following a period of personal leave, the Full Time Employee will be entitled to take further personal leave if available, annual leave if available or unpaid leave until they are mobilised,or they have completed their Swing. 19.14 In circumstances where the Full Time Employee is unable to be mobilised for any reason other than those detailed in the subclause above, any On-duty hours of work missed after 24hour from the Employee being declared fit to return to work will be need to be made up as provided for in subclause 12.16 of this Agreement or paid as standby as provided for in subclause 12.14. Taking personal leave during a notice period 19.15 The Employee will be entitled to take sick/carers leave during a worked notice period of termination if the term is covered by a medical certificate. 20. Notice and Evidence Required Wood Offshore Maintenance Greenfields Agreement 2321.2 An Employee, being either a Full Time or an eligible Casual Employee, shall notify the Company as soon as practicable of the date upon which the Employee is required to attend Jury service. Further the Employee shall give the Company proof of attendance, the durationof such attendance and the amount received for such attendance. Jurv Service Period 21.3 The Company will not pay any entitlement under this clause where the Employee chooses to leave work prior to being required to attend Jury service. However, where applicable the Employee will be entitled to use another form of approved leave to cover the unpaid periods. 21.4 The entitlement to Jury Service will only be paid for actual days in attendance, however, if: • Jury duty continues from a Friday to the Monday of next week; and • The Employee is rostered to work during the On-duty Period; and • The Employee is unable to return to work due to the unavailability of flights; then the Employee will be paid the hours they would have worked at the applicable Onshore Pay. 22. LONG SERVICE LEAVE 22.1 The provisions of the Construction Industry Portable Long Service Leave Act 1985 as amended from time to time and paid in line with the Long Service Leave Act 1985, will be applied to Employees employed under this Agreement. For the avoidance of doubt, Long Service Leave accrual will be calculated on the ordinary hours (Rostered Hours of Work) ofthe applicable Work Cycle. 23. PARENTAL LEAVE 23.1 Parental leave provisions as prescribed in the Act and the applicable Company policy, asamended, will set the minimum standards for eligible Employees under this Agreement. 23.2 For the purposes of this clause, the term Parental Leave shall include an entitlement tomaternity leave, paternity leave and adoption leave. 24. ANNUAL LEAVE 24.1 As provided for in the NES a Full Time Employee shall progressively accrue 4 weeks (168hours) of annual leave entitlement over every 12 months of continuous service. 24.2 As provided for in the NES a Full Time Employee who is a "Continuous Shift Worker" as defined in Cl. 4 shall progressively accrue 5 weeks (210 hours) of annual leave entitlementover every 12 months continuous service. 24.3 Employees may take a period of annual leave during their On-duty Period and/or their Off-duty Period of their Work Cycle. 24.4 Where an Employee schedules annual leave during the On-duty Period they will provide the Company with at least three (3) months notice prior to taking that leave. For leave takenduring the Off-duty period they will provide at least one swing of notice. 24.5 Otherwise than as stated in this Agreement, where an Employee schedules annual leave during their On -duty Period, the leave may only be taken as a complete Work Cycle or WorkCycles. 24.6 Annual Leave when taken will be paid at the Offshore Pay and the offshore allowance will be applicable. 24. 7 Annual leave may be cashed out in accordance with the following provisions: • Paid annual leave must not be cashed out if the cashing out would result in the Employee's remaining accrued entitlement to paid annual leave being less than 12 months of entitlement; and • Each cashing out of paid annual leave must be by a separate agreement in writing between the Company and the Employee; and Wood Offshore Maintenance Greenfie/ds Agreement 24 21.2 An Employee, being either a Full Time or an eligible Casual Employee, shall notify the Company as soon as practicable of the date upon which the Employee is required to attend Jury service. Further the Employee shall give the Company proof of attendance, the durationof such attendance and the amount received for such attendance. For leave takenduring the Off-duty period they will provide at least one swing of notice. 24.5 Otherwise than as stated in this Agreement, where an Employee schedules annual leave during their On -duty Period, the leave may only be taken as a complete Work Cycle or WorkCycles. 24.6 Annual Leave when taken will be paid at the Offshore Pay and the offshore allowance will be applicable. 24.7 Annual leave may be cashed out in accordance with the following provisions: · Paid annual leave must not be cashed out if the cashing out would result in the Employee's remaining accrued entitlement to paid annual leave being less than 12 months of entitlement; and Each cashing out of paid annual leave must be by a separate agreement in writing between the Company and the Employee; and Wood Offshore Maintenance Greenfields Agreement 24• The Employee will be paid out the same amount they would have received had they taken the annual leave. 40% Roster 24.8 Where the Company introduces a 40% Roster, the Company may reasonably require that a Full Time Employee takes accrued annual leave as part of the roster. For the avoidance of doubt, when an employee is engaged under a 40% Roster as detailed in subclause 12.6.c) or 12.6.d) or equivalent, annual leave will be taken by the Employee within each designated Off- Duty period of the Work Cycle as it progressively accrues. 25. CEREMONIAL LEAVE 25.1 The Company is committed to the principals and objectives of reconciliation where we work towards a future that recognises the contribution of Aboriginal or Torres Strait Island peoples. 25.2 On the provision of reasonable notice and with approval from the Company, a Full Time Employee who is legitimately required by Aboriginal tradition to be absent from work for an Aboriginal ceremonial purposes will be entitled to take a single absence of up to 10 workingdays unpaid leave in each year of continuous service. 25.3 In circumstances where a Full Time Employee is unable to be mobilised due to logistical or operational reason following a period of Ceremonial leave, the Employee will be entitled to take annual leave if available or unpaid leave until they are mobilised or they have completedtheir Swing. 26. FAMILY AND DOMESTIC VIOLENCE LEAVE 26.1 An Employee, including a Casual Employee, is entitled to five (5) days unpaid leave to dealwith family and domestic violence as follows: a) Leave is available in full at the start of each 12 month period of the Employee's employment; and b) Leave does not accumulate from year to year. 26.2 In this clause: a) "Family and Domestic Violence" means violent, threatening or other abusive behaviour bya family member of an employee that seeks to coerce or control the employee and that causes them harm or to be fearful. b) "Family Member" means a spouse, de facto partner, child, parent, grandparent, grandchildor sibling of the employee; or child parent, grandparent, grandchild of sibling of a spouse (including former) or de facto (including former) partner of the employee; or a person related to the employee according to Aboriginal or Torres Strait Islander kinship rules. 26.3 An employee may take unpaid leave under this clause where the employee is experiencing family or domestic violence; and need to do something to deal with the impact of the familyand domestic violence and it is impractical for the employee to do that thing outside theirordinary hours of work. 26.4 Leave taken for this purpose does not count as service but does not break the employee's continuity of service. 26.5 An employee must provide notice of taking leave as soon as practicable and advise theCompany of the period, or expected period, of the leave. 26.6 An employee will be required to provide evidence to the employer that would satisfy a reasonable person that the leave is taken for the purpose specified in this clause. Satisfactory evidence may include a document issued by the police, a court or a family violence support service. Where it is not reasonably practicable to provide such document, evidence may include a statutory declaration made by the Employee attesting to the purpose of taking the leave. 26.7 In circumstances where a Full Time Employee is unable to be mobilised due to logistical or Wood Offshore Maintenance Greenfields Agreement 25 The Employee will be paid out the same amount they would have received had they taken the annual leave. 40% Roster 24.8 Where the Company introduces a 40% Roster, the Company may reasonably require that a Full Time Employee takes accrued annual leave as part of the roster. For the avoidance of doubt, when an employee is engaged under a 40% Roster as detailed in subclause 12.6.c) or 12.6.d) or equivalent, annual leave will be taken by the Employee within each designated Off- Duty period of the Work Cycle as it progressively accrues. 25. PUBLIC HOLIDAYS 27.1 The Company will require an Employee to work on a Public Holiday where it falls during an Employee's rostered Work Cycle. 27.2 Time worked on a Public Holiday will be paid at the base hourly rate of pay as provided for in Schedule 1 of this Agreement. 27.3 An Employee who is not rostered to work on a public holiday is not entitled to payment forsuch a day. 28. WORKERS COMPENSATION 28.1 An Employee shall not be entitled to take personal/carer's leave (whether paid or unpaid) forany period which the Employee is entitled to receive workers' compensation payments. 28.2 A Full Time Employee is entitled to take or be paid annual leave for any period which theEmployee is entitled to receive workers compensation payments. 28.3 An Employee is not entitled to accrue any paid personal leave during aperiod which the Employee is absent from work because of personal injury/illness for which the Employee is receiving workers' compensation payments. 29. TRAINING/MEETINGS/MEDICALS Traininq 29.1 Employees may be required to attend training, meetings and medicals during both their On-duty Period and their Off-duty Period while they are not on the Offshore Facility. 29.2 Employees (Full Time and casual) are required to possess and maintain the qualificationsand skills required to perform the role for which they were engaged and to enable the Employee to work offshore. 29.3 The Employee will be responsible for any fees associated with the maintaining of licenses ortrade qualifications. For clarity, this includes Electrical Licenses, High Risk Licenses, and trade qualification inherent requirements. 29.4 The Company will provide and pay for the following refreshers, renewals and training for: Full Time Employees; or casual Employees currently engaged and who have completed at least 12 weeks (1008 hours) of offshore work (excludes Off-Duty Periods) in the preceding 9-month period; who are required by the Company to undertake duties requiring the refresher, renewal or training: • BOSIET/FOET i.e. T-BOSIET/T-FOET • MSIC • Confined Space Entry • Working at Heights • First Aid • LVR/CPR • EEHA - Inlec/Elec • Flange Management Level 1 & 2 • Gyroloc Small Bore Fittings Wood Offshore Maintenance Greenfields Agreement 26 operational reason following a period of Family and Domestic Violence Leave, the Employeewill be entitled to take annual leave if available or unpaid leave until they are mobilised or they have completed their Swing. 27. PUBLIC HOLIDAYS 27.1 The Company will require an Employee to work on a Public Holiday where it falls during an Employee's rostered Work Cycle. 27.2 Time worked on a Public Holiday will be paid at the base hourly rate of pay as provided for in Schedule 1 of this Agreement. 27.3 An Employee who is not rostered to work on a public holiday is not entitled to payment forsuch a day. 28. WORKERS COMPENSATION 28.1 An Employee shall not be entitled to take personal/carer's leave (whether paid or unpaid) forany period which the Employee is entitled to receive workers' compensation payments. 28.2 A Full Time Employee is entitled to take or be paid annual leave for any period which theEmployee is entitled to receive workers compensation payments. 28.3 An Employee is not entitled to accrue any paid personal leave during aperiod which the Employee is absent from work because of personal injury/illness for which the Employee is receiving workers' compensation payments. 29. TRAINING/MEETINGS/MEDICALS Training 29.1 Employees may be required to attend training, meetings and medicals during both their On-duty Period and their Off-duty Period while they are not on the Offshore Facility. 29.2 Employees (Full Time and Casual) are required to possess and maintain the qualificationsand skills required to perform the role for which they were engaged and to enable the Employee to work offshore. 29.3 The Employee will be responsible for any fees associated with the maintaining of licenses ortrade qualifications. For clarity, this includes Electrical Licenses, High Risk Licenses, and trade qualification inherent requirements. 29.4 The Company will provide and pay for the following refreshers, renewals and training for: Full Time Employees; or - Casual Employees currently engaged and who have completed at least 12 weeks (1008 hours) of offshore work (excludes Off-Duty Periods) in the preceding 9-month period; who are required by the Company to undertake duties requiring the refresher, renewal or training: · BOSIET/FOET i.e. T-BOSIET/T-FOET . MSIC Confined Space Entry Working at Heights First Aid LVR/CPR EEHA - Inlec/Elec Flange Management Level 1 & 2 Gyroloc Small Bore Fittings Wood Offshore Maintenance Greenfields Agreement 26• CA-EBS • voes for High Risk Licenses and Welder Qualifications • Rope Access • NACE Levels 1, 2 or 3. 29.5 For training which is a requirement for the Employee being able to work Offshore, the Employee will be responsible to ensure any applicable training is scheduled prior to expiry.All Company provided training must be approved by the Company prior to it being undertaken. 29.6 In addition to the training in subclause 29.4 the Company may also require an Employee undertake additional training for operational reasons or upskilling. 29. 7 The Company will endeavour to provide at least eight (8) 'NElE!ks' ndice of nctire where training is expedEd to ocrur on an Off-duty period. 29.8 Employees who have a Usual Place of Residence of more than 100km from the designatedtraining location, and are required to attend training which continues for more than oneconsecutive day in duration, will be provided accommodation and meals (an evening mealand breakfast) for each night of accommodation required for the training duration. For avoidance of doubt, for a two (2) day course, one night of accommodation plus two (2) associated meals. 29. 9 The Company will endeavor for Employees who live in regional areas or outside of Western Australia to be offered the opportunity of undertaking training and voe at an approved RTO closest to their Usual Place of Residence. Pa yment for Traininq/Meetinq 29.10 Where an Employee is required to attend training as provided for in subclause 29.4 and 29.6during their Off-Duty period while they are not on the Offshore Facility they will be paid forthe duration of the training at the Onshore Pay. 29.11 Where an Employee is required to attend a meeting onshore, they will be paid for theduration of the meeting at the Onshore Pay. Medicals 29.12 Employees will be required, as an inherent part of their role, to hold a current medical as per Client requirements. 29.13 Pre-employment medicals will be provided by the Company however this will be undertakenas part of the pre-employment process and the time will be unpaid. 29.14 Where an Employee is required to have their medical renewed, the Company will provide the medical and the Employee shall receive a payment of four (4) hours pay at the Onshore Pay for the time taken to complete the medical. 29.15 Where an Employee is required to complete a medical for a return to work situation after absence, the medical will be provided by the Company and the time will be unpaid. Return to work medicals will only be required where the Company has a genuine concern regardingthe ability for the Employee to be able to safely undertake their role and will be managedthrough the Company Health and Rehabilitation department. 30. PAYMENT OF WAGES Pa yment of Waqes 30.1 All monies paid pursuant to this Agreement shall be paid fortnightly by electronic transfer offunds into one account nominated by the Employee with a bank or other financial institution recognised by the Company. 30.2 The Company shall have the right to deduct any amount required to be paid by the Employee under this clause for cases of any overpayment or there are outstanding monies owing by the Employee to the Company. Prior to any deduction the Company will put in writing to the Employee details of the overpayment, the outstanding amount and a proposed deduction method. For avoidance of doubt, for a two (2) day course, one night of accommodation plus two (2) associated meals. 29.9 The Company will endeavor for Employees who live in regional areas or outside of Western Australia to be offered the opportunity of undertaking training and VOC at an approved RTO closest to their Usual Place of Residence. Payment for Training/Meeting 29.10 Where an Employee is required to attend training as provided for in subclause 29.4 and 29.6during their Off-Duty period while they are not on the Offshore Facility they will be paid forthe duration of the training at the Onshore Pay. 29.11 Where an Employee is required to attend a meeting onshore, they will be paid for theduration of the meeting at the Onshore Pay. Medicals 29.12 Employees will be required, as an inherent part of their role, to hold a current medical as per Client requirements. 29.13 Pre-employment medicals will be provided by the Company however this will be undertakenas part of the pre-employment process and the time will be unpaid. 29.14 Where an Employee is required to have their medical renewed, the Company will provide the medical and the Employee shall receive a payment of four (4) hours pay at the Onshore Pay for the time taken to complete the medical. 29.15 Where an Employee is required to complete a medical for a return to work situation after absence, the medical will be provided by the Company and the time will be unpaid. Return to work medicals will only be required where the Company has a genuine concern regardingthe ability for the Employee to be able to safely undertake their role and will be managedthrough the Company Health and Rehabilitation department. 30. The agreed plan for repayment will not exceed three (3) months. If an agreed position cannot be reached, either party may place the overpayment in disputeunder Cl.9 of this Agreement. In circumstances where the Employee's employment is terminated and there are outstanding monies owed by the Employee to the Company, including overpayments made to the Employee, the Company may withhold the outstanding amount from the final payment. Pav Queries 30.3 The Employer is committed to responding to Employee payroll queries in a timely fashionand where possible, make any necessary pay adjustments in the next available pay. 30.4 Where an Employee has an issue regarding their pay, they are required to state their queryclearly in writing using the payroll query process. 30.5 The Employer will respond to this query no later than 10 business days from the date the query was submitted. Where the Employee does not agree with the response, the Employee isto arrange a meeting via their manager with the payroll team. 30.6 Should the Employee not receive or continue to dispute the response, the Employee is able escalate their claim utilising the disputes procedure in this Agreement, by submitting thequery in writing with any relevant documents to their Manager. The relevant CCM representative can be consulted to assist in this process. 31. STAND DOWN Stand Down 31.1 In the event the Company is unable to provide normal work due to a failure in critical equipment, industrial action, or any circumstances beyond the Company and the Client'scontrol, the Company is entitled to stand down an Employee and the Company is not required to pay for any such day on which the Employee cannot be gainfully employed because of such an event. Where a stand down is to occur, the Company will provide asmuch notice as possible. For the avoidance of doubt, for Full Time employees bed busts are not considered as circumstances beyond the Client's control and a stand down for bed availability under this subclause will not be applicable. In bed bust situations the Company will treat missed shiftsas 'make up hours' as provided for in subclause 12.16 or as 'standby' as provided for in subclause 12.14 or 12.15. 31.2 Where a stand down occurs, Full Time Employees will be permitted to take their annual leave accrual until exhausted. 31.3 In lieu of enacting a stand down, the Company may require an Employee to undertake onshore training or alternative duties where the Employee will be paid the Onshore pay. Cyclone Stand Down 31.4 The following subdauses will apply where a cyclone disrupts operations. 31.5 Where the Employee (Full Time or casual) is retained on the Offshore Facility during a cyclone event, tl1e Employee will continue to be paid the Employee's Rostered Hours of Workthey were scheduled to complete at the Offshore Pay. If the Employee remains on the Offshore Facility beyond their Work Cycle, they will continue to be regarded as being at work working their customary hours and will be paid Over Cycle until they are demobilised. 31.6 Where an Employee (Full Time or casual) is held in standby at the Point of Assembly, the Employee shall be held in readiness and continue to be paid their Rostered Hours of Work atthe Onshore Pay. This payment will be paid at the Night Shift Hourly Rate of Pay if the Employee is being required to return to Night Shift should they be mobilised to the Offshore Facility. 31.7 Where an Employee (Full Time or casual) is stood down to their Point of Hire or is waiting to Wood Offshore Maintenance Greenfields Agreement 28 Employee disputes the deduction prior to the next available pay period, the Company will not deduct the money until the amount and deduction method is discussed andagreed. The agreed plan for repayment will not exceed three (3) months. If an agreed position cannot be reached, either party may place the overpayment in disputeunder CI.9 of this Agreement. This payment will be paid at the Night Shift Hourly Rate of Pay if the Employee is being required to return to Night Shift should they be mobilised to the Offshore Facility. 31.7 Where an Employee (Full Time or Casual) is stood down to their Point of Hire or is waiting to Wood Offshore Maintenance Greenfields Agreement 28mobilise to begin their Work Cycle, the Employee shall be held in readiness and paid 7.6 hours per On-duty Period shift at the Onshore Pay for a maximum of three (3) On-duty Perioddays. The applicable three (3) days shall include any stand down days paid at the Point of Assembly as provided for in subclause 31.6. 31.8 After three (3 days) stand down as provided for in subclause 31.7, if an Employee is unableto be mobilised due to the cyclone or damage caused by the cyclone, a stand down as provided for in subclause 31.1 may be applied. 31.9 In circumstances where a Full Time employee remains at their Point of Hire after the three (3) day cyclone stand down period, or the decision is made by the Company the Employee shall not return to the facility for reasons outside of an eligible stand down (ie awaiting flights or close to the end of their Swing), the Full Time employee will be held in readiness for the remainder of their Swing and missed shifts will be treated as 'make up hours' as provided for in subclause 12.16 or as 'standby' as provided for in subclause 12.14 as determined by the Company. 31.10 For a casual Employee, unworked days at the Point of Hire after three (3) stand down dayswill not be paid. 31.11 If an Employee is held in readiness and required to return to the facility during their Swing,and is unavailable, the Employee will not be paid for the cyclone stand down/held in readiness period. 31.12 In lieu of enacting a cyclone stand down, the Company may require an Employee to undertake onshore training or alternative duties where the Employee will be paid at the Onshore Pay. For clarity, any paid hour for training or alternative duties is paid in lieu of a paid hour for cyclone stand down as provided for in subclause 31.6 or 31.7 and should thealternative training/work not cover the duration of stand down hours, the Employee will be paid the outstanding hours depending where the training/alternative duties take place. 32. PPE & PROTECTIVE CLOTHING 32.1 Upon mobilisation all offshore Employees will be issued: • three sets of overalls; and • one pair of safety boots. 32. 2 Consumable PPE (hard hats, safety glasses, gloves etc) will be provided to all emJl()YeeS r:re mobilisation. Replacement PPE will either be made available offshore or sent to the offshore facility as required.All PPE will be re-supplied on a fair wear and tear basis for all Employees. 32.3 Where the Employee purchases their own pair of prescription safety glasses that meet Australian Standards (AS/NZ 1337.6:2012 or as amended), the Company will reimburse thecost of the purchase up to $300 and replace where the Employee is able to show fair wear and tear of the glasses. 33. OFFSHORE EMPLOYEES WORKING ONSHORE 33.1 From time to time an Offshore Employee may be asked to work Onshore, where they will bepaid at the Onshore Pay. 33.2 If an Offshore Employee agrees to undertake a short-term Perth, Darwin or other location- based onshore assignment, the Employee may be required to work a different work pattern orWork Cycle for the duration of the assignment which may include a Monday to Friday 5-dayweek. 33.3 All other entitlements and conditions under the Agreement would remain the same. 34. CLASSIFICATIONS 34.1 This Agreement provides for a five-level classification structure which encapsulated recognition for skills and competencies. In addition, there is a recognition process for various specialist skills and positions held in terms of specified allowances across the offshore operations. Multi-skilling and multi-tasking are a fundamental part of all classifications prescribed within this agreement. 34.2 The parties agree that the dassification structure within this Agreement needs to be reviewed so as the qualifications, skills, and competencies associated with each Level adequately reflect the required tasks to Wood Offshore Maintenance Greenfietds Agreement 29 mobilise to begin their Work Cycle, the Employee shall be held in readiness and paid 7.6 hours per On-duty Period shift at the Onshore Pay for a maximum of three (3) On-duty Perioddays. The applicable three (3) days shall include any stand down days paid at the Point of Assembly as provided for in subclause 31.6. 31.8 After three (3 days) stand down as provided for in subclause 31.7, if an Employee is unableto be mobilised due to the cyclone or damage caused by the cyclone, a stand down as provided for in subclause 31.1 may be applied. 31.9 In circumstances where a Full Time employee remains at their Point of Hire after the three (3) day cyclone stand down period, or the decision is made by the Company the Employee shall not return to the facility for reasons outside of an eligible stand down (ie awaiting flights or close to the end of their Swing), the Full Time employee will be held in readiness for the remainder of their Swing and missed shifts will be treated as 'make up hours' as provided for in subclause 12.16 or as 'standby' as provided for in subclause 12.14 as determined by the Company. 31.10 For a Casual Employee, unworked days at the Point of Hire after three (3) stand down dayswill not be paid. 31.11 If an Employee is held in readiness and required to return to the facility during their Swing, and is unavailable, the Employee will not be paid for the cyclone stand down/held in readiness period. 31.12 In lieu of enacting a cyclone stand down, the Company may require an Employee to undertake onshore training or alternative duties where the Employee will be paid at the Onshore Pay. For clarity, any paid hour for training or alternative duties is paid in lieu of apaid hour for cyclone stand down as provided for in subclause 31.6 or 31.7 and should thealternative training/work not cover the duration of stand down hours, the Employee will be paid the outstanding hours depending where the training/alternative duties take place. 32. Boilermaker/Welder holds: - Special Coded; and - Compliance with client trade specific training matrix. Painter Blaster Trade holds: Certificate 3 in Engineering Fabrication Trade - Surface Finishing; and NACE (Level 1 or 2) qualification; and Compliance with client trade specific training matrix. Crane Operator holds: - HRWL with codes RA, SA, DG, CT; and - Offshore tower crane operator with Crane simulator (PMASUP305); and - Site specific voe (Pedestal Crane Operator); and - Compliance with client trade specific training matrix; and - A minimum of 3 of either Coxswain; Emergency Response Team Member; Helideckassistant; complete role requirements; or HLO. and • Signed off as competent by: Wood Offshore Maintenance Greenfields Agreement 31 Employees will be engaged in one of the Classifications in the table below: Senior Trade / Technician Employees shall be appointed by the Company to this classification from a Trade the following: classification. Trade Employees engaged at this classification include: • Inlec (Instrument and Electrical) • Electrician or Electrical Fitter • Instrument Fitter • HVAC Technician • Mechanical Fitter • Boilermaker/Welder • Sheetmetal Worker/Insulator Trade • Tube Fitter/Pipe Fitter Trade (Including plumber trades) • Industrial Painter and Blaster (trade qual Cert III Surface Finishing) !fechnician - An offshore endorsed Crane Operator will be recognised at this level. • Senior/Multiskilled Services Technician - Non-Trade Employees shall be appointed by the Company to this classification from a Services Technician classification. To be appointed, Senior Services Technician Employees must demonstrate the following: • Length of service - 12 months continuous service with the Company in the Services Technician - Non-Trade role on the Project; and • Competency- In addition to their original Service Employee classification qualifications and competency, Employees will hold and utilise an additional qualification and competency in one of the roles below: Advanced Rigger and Advanced Scaffolder Industrial Painter/Blaster - Qualified and experienced Insulator/Lagger - Non-Trade - Qualified and experienced Service Technician - Non-Trade - Qualified, experienced and completes Heli Ops, Marine Ops and Deck Ops. For avoidance of doubt, an Advanced Rigger and Advanced Scaffolder who is also competent and required to undertake the duties of a qualified Service Technician from time to time will be recognised at this level. Wood Offshore Maintenance Greenfields Agreement 32 Trade / Technician Trade - Employee must hold a trade qualification that is recognised and utilised by the Company.
