Application for approval of the Samboot Pty Ltd Enterprise Agreement 2016.
[1] An application has been made for approval of an enterprise agreement known as the
Samboot Pty Ltd Enterprise Agreement 2016 (the Agreement). The application was made
pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Samboot Pty Ltd
T/A Samford Pet Resort and Northshore Pet Resort. The Agreement is a single enterprise
agreement.
[2] The Applicant has provided written undertakings. A copy of the undertakings is
attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment
to any employee covered by the Agreement and that the undertakings will not result in
substantial changes to the Agreement.
[3] Subject to the undertakings referred to above, I am satisfied that each of the
requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have
been met.
[4] The Agreement was approved on 4 July 2016 and, in accordance with s.54, will
operate from 11 July 2016. The nominal expiry date of the Agreement is 4 July 2020.

Approval of an Enterprise Agreement Undertaking $190 Name of Enterprise Agreement: Samboot Pty Ltd Enterprise Agreement 2016 Relevant clause: Part 1, Clause 1.6 Date and Period of Operation Application This undertaking applies to an application for the approval of an Enterprise Agreement by Fair Work Commission. Undertaking Clause 1.6 is replaced with the following words: This Agreement will nominally expire 4 years from the date of approval of the Fair Work Commission. Employers Signature: 1. Undertaking Enterprise Agreement: Samboot Pty Ltd Enterprise Agreement 2016 Lodgement Reference: AG2016/3067 The Employer makes the following Undertaking. The terms below will be applied for the life of the Enterprise Agreement and amend the requirements of the Clauses listed below. Clause 3.1 : Grievance and dispute settlement procedure For the life of the Enterprise Agreement, the Grievance and Dispute Settlement Procedure shall include any dispute about a matter that relates to the National Employment Standards. Clauses 7.4 and 10.4 : Parental Leave For the life of the Enterprise Agreement, the notice period required for commencement of parental leave will be consistent with the period of notice specified in the National Employment Standards. Clause 7.2.4 and 10.2.6 : Unpaid personal/carer's leave For the life of the Enterprise Agreement, Employees shall not be required to provide a medical certificate for unpaid personal/carer's leave and all unpaid personal/carer's leave will be granted to all employees (including casual employees) in accordance with the National Employment Standards. Clauses 7.6.2 and 10.6.2 : Community services leave For the life of the Enterprise Agreement, an Employee who performs Community Service Leave as authorised by the National Employment Standards shall not be required to provide a medical certificate prior to the Employee's return to work after the cessation of the Community Service Leave. Clause 10.7 : Payment for public holidays - flexible permanent part-time employees For the life of the Enterprise Agreement, part-time employees whose ordinary part-time hours include the day of the week on which the public holiday occurs will be entitled to payment for that public holiday if not required to work either in accordance with the National Employment Standards or in accordance with the provisions of clause 10.7 of the agreement whichever is more beneficial to the employee.
